1 AN ACT concerning carnivals.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Municipal Code is amended by
5 changing Section 11-54.1-2 as follows:
6 (65 ILCS 5/11-54.1-2) (from Ch. 24, par. 11-54.1-2)
7 Sec. 11-54.1-2. No carnival shall be set up, run,
8 operated or conducted within the limits of a city, village or
9 incorporated town unless a written permit from the corporate
10 authorities has been issued, setting forth the conditions
11 under which such carnival shall be operated. An application
12 for a written permit to set up, run, operate, or conduct a
13 carnival in accordance with this Section shall include
14 without limitation the name, date of birth, and social
15 security number of the applicant and each employee or
16 subcontractor that the applicant, at the time of the
17 application, expects to be on site for the carnival. The
18 corporate authorities shall provide a copy of the permit
19 application to the local law enforcement agency. The permit
20 shall be granted upon the condition that there shall not be
21 set up or operated any gambling device, lottery, number or
22 paddle wheel, number board, punch board, or other game of
23 chance, or any lewd, lascivious or indecent show or
24 attraction making an indecent exposure of the person or
25 suggesting lewdness or immorality.

27 Section 10. The Carnival Regulation Act is amended by
28 changing Section 2 as follows:

1 Sec. 2. No carnival shall be set up, run, operated or
2 conducted except within the limits of an incorporated
3 municipality, as provided in Division 54.1 of Article 11 of
4 the "Illinois Municipal Code", approved May 29, 1961, as
5 heretofore and hereafter amended, or within the limits or
6 upon the grounds of a State or county fair association, or
7 any association entitled to share in the funds appropriated
8 by the State for distribution among fair associations of the
9 State, and unless a written permit from the proper fair board
10 has been issued, setting forth the conditions under which
11 such carnival shall be operated. An application for a written
12 permit to set up, run, operate, or conduct a carnival in
13 accordance with this Section shall include without limitation
14 the name, date of birth, and social security number of the
15 applicant and each employee or subcontractor that the
16 applicant, at the time of the application, expects to to be
17 on site for the carnival. The fair board shall provide a copy
18 of the permit application to the local law enforcement
19 agency. The permit shall be granted upon the condition that
20 there shall not be set up or operated any gambling device,
21 lottery, number or paddle wheel, number board, punch board,
22 or other game of chance, or any lewd, lascivious or indecent
23 show or attraction making an indecent exposure of the person
24 or suggesting lewdness or immorality.
