1 AMENDMENT TO HOUSE BILL 41
2 AMENDMENT NO. . Amend House Bill 41 by replacing the
3 title with the following:
4 "AN ACT in relation to criminal law."; and
5 by replacing everything after the enacting clause with the
6 following:
7 "Section 5. The Unified Code of Corrections is amended by
8 adding Section 3-12-16 as follows:
9 (730 ILCS 5/3-12-16 new)
10 Sec. 3-12-16. Helping Paws Service Dog Program.
11 (a) In this Section:
12 "Disabled person" means a person who suffers from a
13 physical or mental impairment that substantially limits one
14 or more major life activities.
15 "Program" means the Helping Paws Service Dog Program
16 created by this Section.
17 "Service dog" means a dog trained in obedience and task
18 skills to meet the needs of a disabled person.
19 "Animal care professional" means a person certified to
20 work in animal care related services, such as grooming,
21 kenneling, and any other related fields.

1 "Service dog professional" means a person certified to
2 train service dogs by an agency, organization, or school
3 approved by the Department.
4 (b) The Department shall establish the Helping Paws
5 Service Dog Program to train committed persons to be service
6 dog trainers and animal care professionals. The Department
7 shall select committed persons in various correctional
8 institutions and facilities to participate in the Program.
9 (c) Priority for participation in the Program must be
10 given to committed persons who either have a high school
11 diploma or have passed the high school level Test of General
12 Educational Development (GED).
13 (d) The Department shall contract with service dog
14 professionals to train committed persons to be certified
15 service dog trainers. Service dog professionals shall train
16 committed persons in dog obedience training, service dog
17 training, and animal health care. Upon successful completion
18 of the training, a committed person shall receive
19 certification by an agency, organization, or school approved
20 by the Department.
21 (e) The Department shall designate a non-profit
22 organization to select animals from humane societies and
23 shelters for the purpose of being trained as service dogs and
24 for participation in any program designed to train animal
25 care professionals.
26 (f) After a dog is trained by the committed person as a
27 service dog, a review committee consisting of an equal number
28 of persons from the Department and the non-profit
29 organization shall select a disabled person to receive the
30 service dog free of charge.
31 (g) Employees of the Department shall periodically visit
32 disabled persons who have received service dogs from the
33 Department under this Section to determine whether the needs
34 of the disabled persons have been met by the service dogs

1 trained by committed persons.
2 (h) Employees of the Department shall periodically visit
3 committed persons who have been certified as service dog
4 trainers or animal care professionals and who have been
5 paroled or placed on mandatory supervised release to
6 determine whether the committed persons are using their
7 skills as certified service dog trainers or animal care
8 professionals.
9 Section 99. Effective date. This Act takes effect upon
10 becoming law.".
