1 AN ACT to amend the Public Utilities Act by changing
2 Section 13-509.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Public Utilities Act is amended by
6 changing Section 13-509 as follows:

8 (Section scheduled to be repealed on July 1, 2001)
9 Sec. 13-509. Agreements for provisions of competitive
10 telecommunications services differing from tariffs. A
11 telecommunications carrier may negotiate with customers or
12 prospective customers to provide competitive
13 telecommunications service, and in so doing, may offer or
14 agree to provide such service on such terms and for such
15 rates or charges as are reasonable, without regard to any
16 tariffs it may have filed with the Commission with respect to
17 such services. Within 30 10 business days after executing
18 any such agreement, the telecommunications carrier shall file
19 any contract or memorandum of understanding for the provision
20 of telecommunications service, which shall include the rates
21 or other charges, practices, rules or regulations applicable
22 to the agreed provision of such service. Any cost support
23 required to be filed with the agreement by some other Section
24 of this Act shall be filed within 30 calendar days after
25 executing any such agreement. Where the agreement contains
26 the same rates, charges, practices, rules, and regulations
27 found in a single contract or memorandum already filed by the
28 telecommunications carrier with the Commission, instead of
29 filing the contract or memorandum, the telecommunications
30 carrier may elect to file a letter identifying the new
31 agreement and specifically referencing the contract or

1 memorandum already on file with the Commission which contains
2 the same provisions. A single letter may be used to file
3 more than one new agreement. Upon filing its contract or
4 memorandum, or letter, the telecommunications carrier shall
5 thereafter provide service according to the terms thereof,
6 unless the Commission finds, after notice and hearing, that
7 the continued provision of service pursuant to such contract
8 or memorandum would substantially and adversely affect the
9 financial integrity of the telecommunications carrier or
10 would violate any other provision of this Act.
11 Any contract or memorandum entered into and filed
12 pursuant to the provisions of this Section may, in the
13 Commission's discretion, be accorded proprietary treatment.

15 Section 99. Effective date. This Act takes effect upon
16 becoming law.
