1 AN ACT to amend the Toll Highway Act by changing Sections
2 3 and 5.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Toll Highway Act is amended by changing
6 Sections 3 and 5 as follows:
7 (605 ILCS 10/3) (from Ch. 121, par. 100-3)
8 Sec. 3. There is hereby created an Authority to be known
9 as The Illinois State Toll Highway Authority, which is hereby
10 constituted an instrumentality and an administrative agency
11 of the State of Illinois. The said Authority shall consist of
12 11 directors; the Governor and the Secretary of the
13 Department of Transportation, ex officio, and 9 directors
14 appointed by the Governor with the advice and consent of the
15 Senate, from the State at large, which said directors and
16 their successors are hereby authorized to carry out the
17 provisions of this Act, and to exercise the powers herein
18 conferred. Of the 9 directors appointed by the Governor, no
19 more than 5 shall be members of the same political party and
20 none shall be a State or local elected official. Vacancies
21 shall be filled for the unexpired term in the same manner as
22 original appointments. All appointments shall be in writing
23 and filed with the Secretary of State as a public record. It
24 is the intention of this section that the Governor's
25 appointments shall be made with due consideration to the
26 location of proposed toll highway routes so that maximum
27 geographic representation from the areas served by said toll
28 highway routes may be accomplished insofar as practicable.
29 The said Authority shall have the power to contract and be
30 contracted with, to acquire, hold and convey personal and
31 real property or any interest therein including rights of

1 way, franchises and easements; to have and use a common seal,
2 and to alter the same at will; to make and establish
3 resolutions, by-laws, rules, rates and regulations, and to
4 alter or repeal the same as the Authority shall deem
5 necessary and expedient for the construction, operation,
6 relocation, regulation and maintenance of a system of toll
7 highways within and through the State of Illinois.
8 Appointment of the additional directors provided for by
9 this amendatory Act of 1980 shall be made within 30 days
10 after the effective date of this amendatory Act of 1980.

13 Sec. 5. Of the original directors, other than the
14 chairman, so appointed by the Governor, 3 shall hold office
15 for 2 years and 3 shall hold office for 4 years, from the
16 date of their appointment and until their respective
17 successors shall be duly appointed and qualified, but shall
18 be subject to removal by the Governor for incompetency,
19 neglect of duty or malfeasance. In case of vacancies in such
20 offices during the recess of the Senate, the Governor shall
21 make a temporary appointment until the next meeting of the
22 Senate when he shall nominate some person to fill such office
23 and any person so nominated, who is confirmed by the Senate,
24 shall hold office during the remainder of the term and until
25 his successor shall be appointed and qualified. The
26 respective term of the first directors appointed shall be
27 designated by the Governor at the time of appointment, but
28 their successors shall each be appointed for a term of four
29 years, except that any person appointed to fill a vacancy
30 shall serve only for the unexpired term. Directors shall be
31 eligible for reappointment.
32 In making the initial appointments of the 2 additional
33 directors provided for by this amendatory Act of 1980, the

1 respective terms of the 2 additional directors first
2 appointed shall be designated by the Governor at the time of
3 appointment in such manner that the term of one such
4 additional director shall expire at the same time as the
5 terms of 4 of the other directors and the term of the other
6 additional director shall expire at the same time as the
7 terms of 3 of the other directors; thereafter the terms shall
8 be 4 years.
9 Each such director, other than ex officio members shall
10 receive an annual salary of $15,000, or as set by the
11 Compensation Review Board, whichever is greater, payable in
12 monthly installments, and shall be reimbursed for necessary
13 expenses incurred in the performance of his duties.
14 A director who also holds an elected office may not
15 receive any contributions from individuals who are vendors
16 for the Authority.

18 Section 99. Effective date. This Act takes effect upon
19 becoming law.
