1 AN ACT concerning substance abuse and violence prevention
2 programs.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Department of Human Services (Alcoholism
6 and Substance Abuse) Law of the Civil Administrative Code of
7 Illinois is amended by adding Section 310-15 as follows:
8 (20 ILCS 310/310-15 new)
9 Sec. 310-15. Substance Abuse and Violence Prevention
10 Program transfer. On the effective date of this amendatory
11 Act of the 91st General Assembly, the Substance Abuse and
12 Violence Prevention Program administered by the State Board
13 of Education is transferred to and continued as a program of
14 the Department of Human Services. On the effective date of
15 this amendatory Act of the 91st General Assembly, the
16 Department shall (i) receive from the State Board of
17 Education and have jurisdiction over all property and assets
18 of the program, (ii) possess all rights and powers necessary
19 to administer the program, and (iii) be subject to all
20 liabilities, debts, and obligations of the program for which
21 the State Board of Education was responsible. Nothing in
22 this Section shall affect the validity of grants issued by
23 the State Board of Education under the Substance Abuse and
24 Violence Prevention Program.
25 Section 10. The School Code is amended by adding Section
26 2-3.131 as follows:

28 Sec. 2-3.131. Substance Abuse and Violence Prevention
29 Program transfer. On the effective date of this amendatory

1 Act of the 91st General Assembly, the Substance Abuse and
2 Violence Prevention Program administered by the State Board
3 of Education is transferred to the Department of Human
4 Services as provided in Section 310-15 of the Department of
5 Human Services (Alcoholism and Substance Abuse) Law of the
6 Civil Administrative Code of Illinois. On the effective date
7 of this amendatory Act of the 91st General Assembly, the
8 State Board of Education shall transfer to the Department of
9 Human Services all rights, powers, assets, and property
10 possessed by the State Board of Education under that program
11 and all liabilities, debts, and obligations that were the
12 responsibility of the State Board of Education under that
13 program.
14 Section 99. Effective date. This Act takes effect July
15 1, 2000.
