1 AN ACT in relation to real property.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Mortgage Act is amended by changing
5 Section 5 as follows:
6 (765 ILCS 905/5) (from Ch. 95, par. 55)
7 Sec. 5. Constructive mortgage. Every deed conveying real
8 estate, which shall appear to have been intended only as a
9 security in the nature of a mortgage, though it be an
10 absolute conveyance in terms, shall be considered as a
11 mortgage.
