1 AN ACT to amend the Emergency Telephone Systems Act by
2 changing Section 10.1.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Emergency Telephone System Act is amended
6 by changing Section 10.1 as follows:
7 (50 ILCS 750/10.1) (from Ch. 134, par. 40.1)
8 Sec. 10.1. Confidentiality.
9 (a) Except as provided otherwise in subsection (b),
10 9-1-1 information consisting of names, addresses and
11 telephone numbers of telephone customers whose listings are
12 not published in directories or listed in Directory
13 Assistance Offices is confidential. Except as provided
14 otherwise in subsection (b), information shall be provided on
15 a call-by-call basis only for the purpose of responding to
16 emergency calls.
17 Divulging confidential information in violation of this
18 Section is a Class A misdemeanor.
19 (b) Nothing in this Section shall prohibit a public
20 agency from using 9-1-1 information, including the
21 information described in subsection (a), in creating or
22 maintaining a separate nonemergency database to be used to
23 assist in the public agency's response to nonemergency calls
24 if:
25 (1) the database is maintained pursuant to a system
26 that permits residents to make nonemergency telephone
27 calls to the public agency by calling a separate and
28 distinct number;
29 (2) the public agency permits any resident at any
30 time to require the public agency to remove from the
31 nonemergency database the information described in

1 subsection (a);
2 (3) the nonemergency database is at all times
3 maintained separately from the public agency's 9-1-1
4 information; and
5 (4) access to the public agency's 9-1-1 information
6 for purposes of this subsection (b) is made only when
7 reasonably necessary to create the nonemergency database
8 and maintain its accuracy.

10 Section 99. Effective date. This Act takes effect upon
11 becoming law.
