1 AN ACT to amend the Illinois Identification Card Act by
2 changing Section 14.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Identification Card Act is
6 amended by changing Section 14 as follows:
7 (15 ILCS 335/14) (from Ch. 124, par. 34)
8 Sec. 14. Unlawful use of identification card.
9 (a) It is a violation of this Section for any person:
10 1. To possess, display, or cause to be displayed a
11 any cancelled or revoked identification card;
12 2. To display or represent as the person's own any
13 identification card issued to another;
14 3. To allow any unlawful use of an identification
15 card issued to the person;
16 4. To lend an identification card to another or
17 knowingly allow the use thereof by another;
18 5. To fail or refuse to surrender to the Secretary
19 of State, the Secretary's agent or any peace officer upon
20 lawful demand, any identification card which has been
21 revoked or cancelled.
22 (a-5) As used in this Section "identification card"
23 means any document made or issued by or under the authority
24 of the United States Government, the State of Illinois or any
25 other State or political subdivision thereof, or any
26 governmental or quasi-governmental organization that, when
27 completed with information concerning the individual, is of a
28 type intended or commonly accepted for the purpose of
29 identifying the individual.
30 (b) Sentence.
31 1. Any person convicted of a violation of this

1 Section shall be guilty of a Class A misdemeanor and
2 shall be sentenced to a minimum fine of $500 or 50 hours
3 of community service, preferably at an alcohol abuse
4 prevention program, if available.
5 2. A person convicted of a second or subsequent
6 violation of this Section shall be guilty of a Class 4
7 felony.
8 (c) This Section does not prohibit any lawfully
9 authorized investigative, protective, law enforcement or
10 other activity of any agency of the United States, State of
11 Illinois or any other state or political subdivision thereof.
