1 AN ACT concerning vehicle registration, amending named
2 Acts.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The State Finance Act is amended by adding
6 Section 5.490 as follows:
7 (30 ILCS 105/5.490 new)
8 Sec. 5.490. The Secretary of State Registration Plate
9 Replacement Fund.
10 Section 10. The Illinois Vehicle Code is amended by
11 changing Sections 2-119, 3-412, and 3-806 as follows:

13 Sec. 2-119. Disposition of fees and taxes.
14 (a) All moneys received from Salvage Certificates shall
15 be deposited in the Common School Fund in the State Treasury.
16 (b) Beginning January 1, 1990 and concluding December
17 31, 1994, of the money collected for each certificate of
18 title, duplicate certificate of title and corrected
19 certificate of title, $0.50 shall be deposited into the Used
20 Tire Management Fund. Beginning January 1, 1990 and
21 concluding December 31, 1994, of the money collected for each
22 certificate of title, duplicate certificate of title and
23 corrected certificate of title, $1.50 shall be deposited in
24 the Park and Conservation Fund. Beginning January 1, 1995,
25 of the money collected for each certificate of title,
26 duplicate certificate of title and corrected certificate of
27 title, $2 shall be deposited in the Park and Conservation
28 Fund. The moneys deposited in the Park and Conservation Fund
29 pursuant to this Section shall be used for the acquisition

1 and development of bike paths as provided for in Section
2 63a36 of the Civil Administrative Code of Illinois. Except as
3 otherwise provided in this Code, all remaining moneys
4 collected for certificates of title, and all moneys collected
5 for filing of security interests, shall be placed in the
6 General Revenue Fund in the State Treasury.
7 (c) All moneys collected for that portion of a driver's
8 license fee designated for driver education under Section
9 6-118 shall be placed in the Driver Education Fund in the
10 State Treasury.
11 (d) Beginning January 1, 1999, of the monies collected
12 as a registration fee for each motorcycle, motor driven cycle
13 and motorized pedalcycle, 27% of each annual registration fee
14 for such vehicle and 27% of each semiannual registration fee
15 for such vehicle is deposited in the Cycle Rider Safety
16 Training Fund.
17 (e) Of the monies received by the Secretary of State as
18 registration fees or taxes or as payment of any other fee, as
19 provided in this Act, except fees received by the Secretary
20 under paragraph (7) of subsection (b) of Section 5-101 and
21 Section 5-109 of this Code, 37% shall be deposited into the
22 State Construction Fund.
23 (f) Of the total money collected for a CDL instruction
24 permit or original or renewal issuance of a commercial
25 driver's license (CDL) pursuant to the Uniform Commercial
26 Driver's License Act (UCDLA), $6 of the total fee for an
27 original or renewal CDL, and $6 of the total CDL instruction
28 permit fee when such permit is issued to any person holding a
29 valid Illinois driver's license, shall be paid into the
30 CDLIS/AAMVAnet Trust Fund (Commercial Driver's License
31 Information System/American Association of Motor Vehicle
32 Administrators network Trust Fund) and shall be used for the
33 purposes provided in Section 6z-23 of the State Finance Act.
34 (g) All remaining moneys received by the Secretary of

1 State as registration fees or taxes or as payment of any
2 other fee, as provided in this Act, except fees received by
3 the Secretary under paragraph (7) of subsection (b) of
4 Section 5-101 and Section 5-109 of this Code, shall be
5 deposited in the Road Fund in the State Treasury. Moneys in
6 the Road Fund shall be used for the purposes provided in
7 Section 8.3 of the State Finance Act.

11 (k) There is created in the State Treasury a special
12 fund to be known as the Secretary of State Special License
13 Plate Fund. Money deposited into the Fund shall, subject to
14 appropriation, be used by the Office of the Secretary of
15 State (i) to help defray plate manufacturing and plate
16 processing costs for the issuance and, when applicable,
17 renewal of any new or existing special registration plates
18 authorized under this Code and (ii) for grants made by the
19 Secretary of State to benefit Illinois Veterans Home
20 libraries.
21 On or before October 1, 1995, the Secretary of State
22 shall direct the State Comptroller and State Treasurer to
23 transfer any unexpended balance in the Special Environmental
24 License Plate Fund, the Special Korean War Veteran License
25 Plate Fund, and the Retired Congressional License Plate Fund
26 to the Secretary of State Special License Plate Fund.
27 (l) The Motor Vehicle Review Board Fund is created as a
28 special fund in the State Treasury. Moneys deposited into
29 the Fund under paragraph (7) of subsection (b) of Section
30 5-101 and Section 5-109 shall, subject to appropriation, be
31 used by the Office of the Secretary of State to administer
32 the Motor Vehicle Review Board, including without limitation
33 payment of compensation and all necessary expenses incurred
34 in administering the Motor Vehicle Review Board under the

1 Motor Vehicle Franchise Act.
2 (m) Effective July 1, 1996, there is created in the
3 State Treasury a special fund to be known as the Family
4 Responsibility Fund. Moneys deposited into the Fund shall,
5 subject to appropriation, be used by the Office of the
6 Secretary of State for the purpose of enforcing the Family
7 Financial Responsibility Law.
8 (n) The Illinois Fire Fighters' Memorial Fund is created
9 as a special fund in the State Treasury. Moneys deposited
10 into the Fund shall, subject to appropriation, be used by the
11 Office of the State Fire Marshal for construction of the
12 Illinois Fire Fighters' Memorial to be located at the State
13 Capitol grounds in Springfield, Illinois. Upon the
14 completion of the Memorial, the Office of the State Fire
15 Marshal shall certify to the State Treasurer that
16 construction of the Memorial has been completed.
17 (o) Of the money collected for each certificate of title
18 for all-terrain vehicles and off-highway motorcycles, $17
19 shall be deposited into the Off-Highway Vehicle Trails Fund.
20 (p) The Secretary of State Registration Plate
21 Replacement Fund is created as a special fund in the State
22 Treasury. Moneys deposited into the Fund shall, subject to
23 appropriation, be used by the Secretary of State for the
24 plate manufacturing and plate processing costs for motor
25 vehicle registrations issued under Section 3-414.1. If at
26 any time the moneys in the Secretary of State Registration
27 Plate Replacement Fund exceed $50,000,000, all moneys in
28 excess of $50,000,000 shall be transferred and deposited into
29 the Road Fund.
30 Beginning January 1, 2000, of the moneys collected as
31 registration fees for vehicles of the first division under
32 Section 3-806 of this Code, $2 of each annual registration
33 fee and $1 of each reduced registration fee shall be
34 deposited into the Secretary of State Registration Plate

7 Sec. 3-412. Registration plates and registration
8 stickers to be furnished by the Secretary of State.
9 (a) The Secretary of State upon registering a vehicle
10 subject to annual registration for the first time shall
11 issue or shall cause to be issued to the owner one
12 registration plate for a motorcycle, trailer, semitrailer,
13 motorized pedalcycle or truck-tractor, 2 registration plates
14 for other motor vehicles and, where applicable, current
15 registration stickers for motor vehicles of the first
16 division. The provisions of this Section may be made
17 applicable to such vehicles of the second division, as the
18 Secretary of State may, from time to time, in his discretion
19 designate. On subsequent annual registrations during the term
20 of the registration plate as provided in Section 3-414.1, the
21 Secretary shall issue or cause to be issued registration
22 stickers as evidence of current registration. However, the
23 issuance of annual registration stickers to vehicles
24 registered under the provisions of Section 3-402.1 of this
25 Code may not be required if the Secretary deems the issuance
26 unnecessary.
27 (b) Every registration plate shall have displayed upon
28 it the registration number assigned to the vehicle for which
29 it is issued, the name of this State, which may be
30 abbreviated, the year number for which it was issued, which
31 may be abbreviated, the phrase "Land of Lincoln", except as
32 provided in Sections 3-626, 3-629, 3-633, 3-634, 3-637,
33 3-638, and 3-642, and such other letters or numbers as the

1 Secretary may prescribe. However, for apportionment plates
2 issued to vehicles registered under Section 3-402.1, the
3 phrase "Land of Lincoln" may be omitted to allow for the word
4 "apportioned" to be displayed. The Secretary may in his
5 discretion prescribe that letters be used as prefixes only on
6 registration plates issued to vehicles of the first division
7 which are registered under this Code and only as suffixes on
8 registration plates issued to other vehicles. Every
9 registration sticker issued as evidence of current
10 registration shall designate the year number for which it is
11 issued and such other letters or numbers as the Secretary may
12 prescribe and shall be of a contrasting color with the
13 registration plates and registration stickers of the previous
14 year.
15 (c) Each registration plate and the required letters and
16 numerals thereon, except the year number for which issued,
17 shall be of sufficient size to be plainly readable from a
18 distance of 100 feet during daylight, and shall be coated
19 with reflectorizing material. The dimensions of the plate
20 issued to vehicles of the first division shall be 6 by 12
21 inches.
22 (d) The Secretary of State shall issue for every
23 passenger motor vehicle rented without a driver the same type
24 of registration plates as the type of plates issued for a
25 private passenger vehicle.
26 (e) The Secretary of State shall issue for every
27 passenger car used as a taxicab or livery, distinctive
28 registration plates.
29 (f) The Secretary of State shall issue for every
30 motorcycle distinctive registration plates distinguishing
31 between motorcycles having 150 or more cubic centimeters
32 piston displacement, or having less than 150 cubic centimeter
33 piston displacement.
34 (g) Registration plates issued to vehicles for-hire may

1 display a designation as determined by the Secretary that
2 such vehicles are for-hire.
3 (h) The Secretary of State shall issue for each electric
4 vehicle distinctive registration plates which shall
5 distinguish between electric vehicles having a maximum
6 operating speed of 45 miles per hour or more and those having
7 a maximum operating speed of less than 45 miles per hour.
8 (i) The Secretary of State shall issue for every public
9 and private ambulance registration plates identifying the
10 vehicle as an ambulance. The Secretary shall forward to the
11 Department of Public Aid registration information for the
12 purpose of verification of claims filed with the Department
13 by ambulance owners for payment for services to public
14 assistance recipients.
15 (j) The Secretary of State shall issue for every public
16 and private medical carrier or rescue vehicle livery
17 registration plates displaying numbers within ranges of
18 numbers reserved respectively for medical carriers and rescue
19 vehicles. The Secretary shall forward to the Department of
20 Public Aid registration information for the purpose of
21 verification of claims filed with the Department by owners of
22 medical carriers or rescue vehicles for payment for services
23 to public assistance recipients.
24 (k) As soon as possible after January 1, 2000, the
25 Secretary of State, from moneys appropriated from the
26 Secretary of State Registration Plate Replacement Fund, shall
27 begin to replace multi-year registration plates issued under
28 Section 3-414.1. After completion of the replacement of the
29 multi-year registration plates, the Secretary of State shall,
30 every 5 years, replace multi-year registration plates issued
31 under Section 3-414.1.

3 Sec. 3-806. Registration Fees - Motor Vehicles of the
4 First Division. Every owner of any other motor vehicle of the
5 first division, except as provided in Sections 3-804, 3-805,
6 3-806.3, and 3-808, and every second division vehicle
7 weighing 8,000 pounds or less, shall pay the Secretary of
8 State an annual registration fee at the following rates:
