1 AMENDMENT TO HOUSE BILL 593
2 AMENDMENT NO. . Amend House Bill 593 by replacing
3 the title with the following:
4 "AN ACT to amend the Election Code by changing Section
5 8-17."; and
6 by replacing everything below the enacting clause with the
7 following:
8 "Section 5. The Election Code is amended by changing
9 Section 8-17 as follows:
10 (10 ILCS 5/8-17) (from Ch. 46, par. 8-17)
11 Sec. 8-17. The death of any candidate prior to, or on,
12 the date of the primary shall not affect the canvass of the
13 ballots. If the result of such canvass discloses that such
14 candidate, if he had lived, would have been nominated, such
15 candidate shall be declared nominated.
16 In the event that a candidate of a party who has been
17 nominated under the provisions of this Article shall die
18 before election (whether death occurs prior to, or on, or
19 after, the date of the primary) or decline the nomination or
20 should the nomination for any other reason become vacant, the
21 legislative or representative committee of such party for

1 such district shall nominate a candidate of such party to
2 fill such vacancy. However, if there was no candidate for the
3 nomination of the party in the primary, no candidate of that
4 party for that office may be listed on the ballot at the
5 general election, unless no candidate from any political
6 party has been nominated, in which case the legislative or
7 representative committee of any the party may nominate
8 nominates a candidate to fill the vacancy in nomination
9 within 60 days after the date of the general primary
10 election. Vacancies in nomination occurring under this
11 Article shall be filled by the appropriate legislative or
12 representative committee in accordance with the provisions of
13 Section 7-61 of this Code. In proceedings to fill the
14 vacancy in nomination, the voting strength of the members of
15 the legislative or representative committee shall be as
16 provided in Section 8-6.
