1 AN ACT to amend the Fire Protection District Act by
2 changing Section 6.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Fire Protection District Act is amended
6 by changing Section 6 as follows:
7 (70 ILCS 705/6) (from Ch. 127 1/2, par. 26)
8 Sec. 6. The trustees shall constitute a board of
9 trustees for the district for which they are appointed, which
10 board of trustees is declared to be the corporate authority
11 of the fire protection district, and shall exercise all of
12 the powers and control all the affairs and property of such
13 district. The board of trustees at their initial meeting and
14 at their first meeting following the commencement of the term
15 of any trustee shall elect one of their number as president
16 and one of their number as secretary and shall elect a
17 treasurer for the district, who may be one of the trustees or
18 may be any other citizen of the district and who shall hold
19 office during the pleasure of the board and who shall give
20 such bond as may be required by the board. Except as
21 otherwise provided in Sections 16.01 through 16.18, the board
22 may appoint a fire chief and such firemen as may be necessary
23 for the district who shall hold office during the pleasure of
24 the board and who shall give such bond as the board may
25 require. The board may prescribe the duties and fix the
26 compensation of all the officers and employees of the fire
27 protection district. A member of the board of trustees of a
28 fire protection district may be compensated as follows: in a
29 district having fewer than 4 full time paid firemen, a sum
30 not to exceed $1,000 per annum; in a district having more
31 than 3 but less than 10 full time paid firemen, a sum not to

1 exceed $1,500 per annum; in a district having either 10 or
2 more full time paid firemen, a sum not to exceed $2,000 per
3 annum. In addition, fire districts that operate an ambulance
4 service pursuant to authorization by referendum, as provided
5 in Section 22, may pay trustees an additional annual
6 compensation not to exceed 50% of the amount otherwise
7 authorized herein. The additional compensation shall be an
8 administrative expense of the ambulance service and shall be
9 paid from revenues raised by the ambulance tax levy. The
10 trustees also have the express power to execute a note or
11 notes and to execute a mortgage or trust deed to secure the
12 payment of such note or notes; such trust deed or mortgage
13 shall cover real estate, or some part thereof, or personal
14 property owned by the district and the lien of the mortgage
15 shall apply to the real estate or personal property so
16 mortgaged by the district, and the proceeds of the note or
17 notes may be used in the acquisition of personal property or
18 of real estate or in the erection of improvements on such
19 real estate. The trustees have express power to purchase
20 either real estate or personal property to be used for the
21 purposes of the fire protection district through contracts
22 which provide for the consideration for such purchase to be
23 paid through installments to be made at stated intervals
24 during a certain period of time, but, in no case, shall such
25 contracts provide for the consideration to be paid during a
26 period of time in excess of 25 years. The trustees have
27 express power to provide for the benefit of its employees,
28 volunteer firemen and paid firemen, group life, health,
29 accident, hospital and medical insurance, or any combination
30 thereof; and to pay for all or any portion of the premiums on
31 such insurance. Such insurance may include provisions for
32 employees who rely on treatment by spiritual means alone
33 through prayer for healing in accord with the tenets and
34 practice of a well recognized religious denomination. The

1 board of trustees may provide retirement benefits for
2 firefighters who are not entitled to a pension under Article
3 4 of the Illinois Pension Code, provided that the cost of
4 funding the retirement benefits, either directly or through
5 contractual arrangements, may not exceed 2% of the annual
6 budget and appropriations of the fire protection district
7 providing the benefits. The board of trustees has express
8 power to change the corporate name of the fire protection
9 district by ordinance provided that notification of any
10 change is given to the circuit clerk and the Office of the
11 State Fire Marshal. The board of trustees has full power to
12 pass all necessary ordinances, and rules and regulations for
13 the proper management and conduct of the business of the
14 board of trustees of the fire protection district for
15 carrying into effect the objects for which the district was
16 formed.
