1 AN ACT to amend the Renewable Energy, Energy Efficiency,
2 and Coal Resources Development Law of 1997 by changing
3 Section 6-6.
4 Be it enacted by the People of the State of Illinois,
5 represented in the General Assembly:
6 Section 5. The Renewable Energy, Energy Efficiency, and
7 Coal Resources Development Law of 1997 is amended by changing
8 Section 6-6 as follows:

11 Sec. 6-6. Energy efficiency program.
12 (a) For the year beginning January 1, 1998, and each
13 succeeding year thereafter as provided in this Section, each
14 electric utility as defined in Section 3-105 of the Public
15 Utilities Act and each alternative retail electric supplier
16 as defined in Section 16-102 of the Public Utilities Act
17 supplying electric power and energy to retail customers
18 located in the State of Illinois shall contribute annually a
19 pro rata share of a total amount of $3,000,000 based upon the
20 number of kilowatt-hours sold by each such entity in the 12
21 months preceding the year of contribution. On or before May
22 1 of each year, the Illinois Commerce Commission shall
23 determine and notify the Department of Commerce and Community
24 Affairs of the pro rata share owed by each electric utility
25 and each alternative retail electric supplier based upon
26 information supplied annually to the Illinois Commerce
27 Commission. On or before June 1 of each year, the Department
28 of Commerce and Community Affairs shall send written
29 notification to each electric utility and each alternative
30 retail electric supplier of the amount of pro rata share they
31 owe. These contributions shall be remitted to the Department

1 of Revenue on or before June 30 of each year the contribution
2 is due on a return prescribed and furnished by the Department
3 of Revenue showing such information as the Department of
4 Revenue may reasonably require. The funds received pursuant
5 to this Section shall be subject to the appropriation of
6 funds by the General Assembly. The Department of Revenue
7 shall place the funds remitted under this Section in a trust
8 fund, that is hereby created in the State Treasury, called
9 the Energy Efficiency Trust Fund. If an electric utility or
10 alternative retail electric supplier does not remit its pro
11 rata share to the Department of Revenue, the Department of
12 Revenue must inform the Illinois Commerce Commission of that
13 such failure. The Illinois Commerce Commission may then
14 revoke the certification of that electric utility or
15 alternative retail electric supplier. The Illinois Commerce
16 Commission may not renew the certification of any electric
17 utility or alternative retail electric supplier that is
18 delinquent in paying its pro rata share.
19 (b) The Department of Commerce and Community Affairs
20 shall disburse the moneys in the Energy Efficiency Trust Fund
21 to residential electric customers to fund projects which the
22 Department of Commerce and Community Affairs has determined
23 will promote energy efficiency in the State of Illinois. The
24 Department of Commerce and Community Affairs shall establish
25 a list of projects eligible for grants from the Energy
26 Efficiency Trust Fund including, but not limited to,
27 supporting energy efficiency efforts for low-income
28 households, replacing energy inefficient windows with more
29 efficient windows, replacing energy inefficient appliances
30 with more efficient appliances, replacing energy inefficient
31 lighting with more efficient lighting, insulating dwellings
32 and buildings, and such other projects as which will increase
33 energy efficiency in homes and rental properties.
34 (c) The Department of Commerce and Community Affairs

1 shall establish criteria and an application process for this
2 grant program.
3 (d) The Department of Commerce and Community Affairs
4 shall conduct a study of other possible energy efficiency
5 improvements and evaluate methods for promoting energy
6 efficiency and conservation, especially for the benefit of
7 low-income customers.
8 (e) The Department of Commerce and Community Affairs
9 shall submit an annual report to the General Assembly
10 evaluating the effectiveness of the projects and programs
11 provided in this Section, and recommending further
12 legislation which will encourage additional development and
13 implementation of energy efficiency projects and programs in
14 Illinois and other actions that help to meet the goals of
15 this Section.
