1 AN ACT to amend the Medical Practice Act of 1987 by
2 changing Section 2.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Medical Practice Act of 1987 is amended
6 by changing Section 2 as follows:
7 (225 ILCS 60/2) (from Ch. 111, par. 4400-2)
8 Sec. 2. Definitions. For purposes of this Act, the
9 following definitions shall have the following meanings,
10 except where the context requires otherwise:
11 (1) 1. "Act" means the Medical Practice Act of 1987.
12 (1-a) "Chiropractic" means a limited portal of entry
13 primary health care profession that contributes to health
14 through the spinal analysis and spinal adjustment of
15 subluxations in the spinal column.
16 As used in this subdivision: "subluxation" means a slight
17 malarticulation of a spinal column segment which occurs in
18 such a way as to disturb nerve function and interfere with
19 the ability of the human body to regain or maintain health;
20 "spinal adjustment" means a specific, localized force
21 introduced to tissue overlaying a segment of the spinal
22 column for the singular purpose of correcting subluxations
23 within the spinal column; and "spinal analysis" means
24 determining the presence and character of subluxations within
25 the spinal column and the appropriateness of chiropractic
26 care through the use of spinal radiographs, accepted
27 non-surgical and non-allopathic examining techniques and
28 non-invasive instrumentation techniques.
29 (1-b) "Chiropractor" means a person licensed under this
30 Act to practice chiropractic.
31 (2) 2. "Department" means the Department of Professional

1 Regulation.
2 (3) 3. "Director" means the Director of Professional
3 Regulation.
4 (4) 4. "Disciplinary Action" means revocation,
5 suspension, probation, supervision, practice modification,
6 reprimand, required education, fines or any other action
7 taken by the Department against a person holding a license.
8 (5) 5. "Disciplinary Board" means the Medical
9 Disciplinary Board.
10 (6) 6. "Final Determination" means the governing body's
11 final action taken under the procedure followed by a health
12 care institution, or professional association or society,
13 against any person licensed under the Act in accordance with
14 the bylaws or rules and regulations of such health care
15 institution, or professional association or society.
16 (7) 7. "Fund" means the Medical Disciplinary Fund.
17 (8) 8. "Impaired" means the inability to practice
18 medicine with reasonable skill and safety due to physical or
19 mental disabilities as evidenced by a written determination
20 or written consent based on clinical evidence including
21 deterioration through the aging process or loss of motor
22 skill, or abuse of drugs or alcohol, of sufficient degree to
23 diminish a person's ability to deliver competent patient
24 care.
25 (9) 9. "Licensing Board" means the Medical Licensing
26 Board.
27 (10) 10. "Physician" means a person licensed under the
28 Medical Practice Act to practice medicine in all of its
29 branches or a chiropractic physician licensed to treat human
30 ailments without the use of drugs and without operative
31 surgery.
32 (11) 11. "Professional Association" means an association
33 or society of persons licensed under this Act, and operating
34 within the State of Illinois, including but not limited to,

1 medical societies, osteopathic organizations, and
2 chiropractic organizations, but this term shall not be deemed
3 to include hospital medical staffs.
4 (12) 12. "Program of Care, Counseling, or Treatment"
5 means a written schedule of organized treatment, care,
6 counseling, activities, or education, satisfactory to the
7 Disciplinary Board, designed for the purpose of restoring an
8 impaired person to a condition whereby the impaired person
9 can practice medicine with reasonable skill and safety of a
10 sufficient degree to deliver competent patient care.
