New Act
Creates the Illinois Car Pool Transportation Act of 1998.
Allows the State and local goverments to designate
high-occupancy lanes. Allows authorities to designate the
occupancy level of vehicles required to use the lane, and the
time of day when lane usage is restricted.

1 AN ACT to create the Illinois Car Pool Transport Act of
2 1998.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 1. Short title. This Act may be cited as the
6 Illinois Car Pool Transport Act of 1998.
7 Section 5. Reservation of highway for use by public
8 transportation vehicles and certain private motor vehicles.
9 The State Department of Transportation and the local
10 authorities, as defined in the Illinois Vehicle Code, are
11 authorized to reserve all or any portion of any highway under
12 their respective jurisdictions, including any designated lane
13 or ramp, for the exclusive or preferential use of public
14 transportation vehicles, or private motor vehicles carrying
15 no fewer than a specified number of passengers. Such
16 limitation shall be employed when it will increase the
17 efficient utilization of the highway or will aid in the
18 conservation of energy resources, specifically motor fuel as
19 defined in the Motor Fuel Tax Law. Regulations authorizing
20 such exclusive or preferential use of a highway facility may
21 be declared to be effective at all times or at specified
22 times of day or on specified days. The State Department of
23 Transportation shall promulgate rules for signage and lane or
24 ramp markings, and shall specify the number of passengers a
25 private motor vehicle must be carrying to be allowed the use
26 of designated lanes or ramps. This Section shall only apply
27 to counties in the State of Illinois with populations greater
28 than one hundred thousand inhabitants.
