Amends the Radiation Protection Act of 1990 to provide
that persons who knowingly make false material statements to
the Department of Nuclear Safety are subject to criminal
penalties. Effective immediately.

1 AN ACT to amend the Radiation Protection Act of 1990 by
2 changing Section 39.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Radiation Protection Act of 1990 is
6 amended by changing Section 39 as follows:
7 (420 ILCS 40/39) (from Ch. 111 1/2, par. 210-39)
8 Sec. 39. Violations.
9 (a) Any person who shall violate any of the provisions
10 of, or who fails to perform any duty imposed by this Act, or
11 who violates any determination or order of the Department
12 promulgated pursuant to this Act, is guilty of a Class A
13 misdemeanor; provided each day during which a violation
14 continues shall constitute a separate offense; and in
15 addition thereto, such person may be enjoined from continuing
16 such violation as hereinafter provided.
17 (b) (1) A person who knowingly makes a false material
18 statement to a Department employee during the course of
19 official Department business or in an application for
20 accreditation, certification, registration, or licensure
21 under this Act is guilty of a Class A misdemeanor for a
22 first offense and is guilty of a Class 4 felony for a
23 second or subsequent offense.
24 (2) A person who knowingly alters a credential,
25 certificate, registration, or license issued by the
26 Department for the purpose of evading a requirement of
27 this Act is guilty of a Class A misdemeanor for a first
28 offense and is guilty of a Class 4 felony for a second or
29 subsequent offense.
30 (c) The penalties provided herein shall be recoverable
31 in an action brought in the name of the People of the State

3 Section 99. Effective date. This Act takes effect upon
4 becoming law.
