Amends the School Code. Requires the State Board of
Education to include students from home schools among the
students who qualify under the free textbook loan program.

1 AN ACT to amend the School Code by changing Section
2 18-17.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The School Code is amended by changing
6 Section 18-17 as follows:
7 (105 ILCS 5/18-17) (from Ch. 122, par. 18-17)
8 Sec. 18-17. The State Board of Education shall provide
9 the loan of secular textbooks listed for use by the State
10 Board of Education free of charge to any student in this
11 State who is enrolled in grades kindergarten through 12 at a
12 public school or at a school other than a public school which
13 is in compliance with the compulsory attendance laws of this
14 State and Title VI of the Civil Rights Act of 1964 or who is
15 educated at home by a parent or guardian in an environment
16 commonly known and referred to as a home school. The
17 foregoing service shall be provided directly to the students
18 at their request or at the request of their parents or
19 guardians. The State Board of Education shall adopt
20 appropriate regulations to administer this Section and to
21 facilitate the equitable participation of all students
22 eligible for benefits hereunder, including provisions
23 authorizing the exchange, trade or transfer of loaned secular
24 textbooks between schools or school districts for students
25 enrolled in such schools or districts. After secular
26 textbooks have been on loan under this Section for a period
27 of 5 years or more, such textbooks may be disposed of by
28 school districts in such manner as their respective school
29 boards shall determine following written notification to the
30 State Board of Education and expiration of a reasonable
31 waiting period not to exceed 30 days. Loaned textbooks may

1 not be disposed of out-of-State or sold without the prior
2 approval of the State Board of Education.
3 As used in this Section, "textbook" means any book or
4 book substitute which a pupil uses as a text or text
5 substitute in a particular class or program. It shall
6 include books, reusable workbooks, manuals, whether bound or
7 in loose leaf form, and instructional computer software,
8 intended as a principal source of study material for a given
9 class or group of students.

11 Section 99. Effective date. This Act takes effect upon
12 becoming law.
