Amends the Chicago Police Article of the Pension Code.
Adds an additional active policeman (of the rank of
investigator or below) to the Board of Trustees. Replaces
one trustee appointed by the mayor with the elected city
clerk, ex officio. Staggers the terms of elected trustees.
Effective immediately.

1 AN ACT to amend the Illinois Pension Code by changing
2 Section 5-178.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Pension Code is amended by
6 changing Section 5-178 as follows:
7 (40 ILCS 5/5-178) (from Ch. 108 1/2, par. 5-178)
8 Sec. 5-178. Board created. A board of 9 8 members shall
9 constitute a board of trustees authorized to administer the
10 provisions of this Article. The board shall be known as the
11 Retirement Board of the Policemen's Annuity and Benefit Fund
12 of the city.
13 The board shall consist of the elected city clerk, who
14 shall serve ex officio; 3 4 persons appointed by the mayor of
15 the city; 4 3 policemen employed by the city, at least one of
16 whom shall be a lieutenant or of a rank superior to
17 lieutenant, one of whom shall be of the rank of sergeant, and
18 2 one of whom shall be of the rank of investigator or a rank
19 inferior to that rank; and one annuitant of the fund, or a
20 pensioner of any prior police pension fund in operation, by
21 authority of law, in the city. Children less than age 18
22 shall not be eligible for board membership. The term of
23 office for all members shall be 3 years, except as otherwise
24 provided in this Section. Upon his election, the members
25 member holding the rank of investigator or a rank inferior to
26 that rank shall be detailed by the Police Superintendent to
27 the office of the board for the duration of their terms his
28 term as trustee.
29 The members of a retirement board holding office in a
30 city at the time this Article becomes effective, including
31 elected, appointed and ex-officio members, shall continue in

1 office until the expiration of their respective terms or
2 appointment and until their respective successors are elected
3 or appointed, and qualified.
4 At least 30 days prior to the expiration of the term of
5 office of each appointive member, the mayor shall appoint a
6 successor for a term of 3 years.
7 The board shall conduct a regular election at least 30
8 days prior to the expiration of the term of each elected
9 member, to elect that member's successor.
10 The term of the appointive member eliminated by this
11 amendatory Act of 1997 shall terminate on the date 30 days
12 after this amendatory Act of 1997 takes effect, at which time
13 the city clerk, ex officio, shall become a member. If the
14 city clerk happens to be an appointive member on that date,
15 then the seat held by the city clerk as an appointive member
16 shall be the one eliminated. Otherwise, at any time prior to
17 that date the mayor may designate which of the appointive
18 members shall be the one whose term shall terminate; if the
19 mayor does not do so, the appointive member to be eliminated
20 shall be chosen by the board by lot on the date the city
21 clerk becomes a member.
22 The active policeman member added by this amendatory Act
23 of 1997 shall first be elected in 1997 for a term beginning
24 in December, 1997. In order to stagger the terms of the
25 elected active members, the active policeman member holding
26 the rank of sergeant to be elected in 1999 shall be elected
27 for a term of 2 years rather than 3 years, and one of the
28 active policeman members holding the rank of investigator or
29 a rank inferior to that rank to be elected in 1999 shall be
30 elected for a term of 4 years rather than 3 years. terms of
31 the active policemen members and annuitant or beneficiary
32 members for election of a successor of each such member for a
33 term of 3 years.
34 Any member of the board so appointed or elected shall

1 continue in office until his successor is selected and has
2 qualified.
3 Any person so appointed or elected shall qualify by
4 taking an oath of office. A copy thereof shall be kept in
5 the office of the city clerk of the city.

7 Section 99. Effective date. This Act takes effect upon
8 becoming law.
