stylistic changes in a Section relating to a utility's
election to file biennial rate proceedings with the Illinois
Commerce Commission.

1 AN ACT to amend the Public Utilities Act by changing
2 Section 16-101.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Public Utilities Act is amended by
6 changing Section 16-101 as follows:
7 (220 ILCS 5/16-101)
8 Sec. 16-101. Short title and applicability.
9 (a) This Article may be cited as the Electric Service
10 Customer Choice and Rate Relief Law of 1997 and shall apply
11 to electric utilities and alternative retail electric
12 suppliers as defined in this Article. Except to the extent
13 modified or supplemented by the provisions of this Article,
14 or where the context clearly renders such provisions
15 inapplicable, the other Articles of the Public Utilities Act
16 pertaining to public utilities, public utility rates and
17 services and the regulation thereof, are fully and equally
18 applicable to the tariffed services electric utilities
19 provide.
20 (b) The provisions of subsections (a) through (h) of
21 Section 16-111 of this Act shall not be applicable to any
22 electric utility that which elects to file biennial rate
23 proceedings before the Commission in the years 1998, 2000,
24 and 2002. An electric utility electing this option shall do
25 so by filing a notice of such election with the Commission
26 within 60 days after December 16, the effective date of this
27 amendatory Act of 1997, or its right to make such election
28 shall be irrevocably waived. An electric utility electing
29 the option specified in this paragraph shall file its rate
30 proceeding with the Commission no later than August 1 of the
31 years 1998, 2000, and 2002. The electric utility's filing

1 shall comply with all requirements of 83 Illinois
2 Administrative Code Parts 255 and 285 as though the electric
3 utility were filing for an increase in its rates, without
4 regard to whether such filing would produce an increase, a
5 decrease or no change in the electric utility's rates and the
6 Commission shall review the electric utility's filing and
7 shall issue its order in accordance with the provisions of
8 Section 9-201 of this Act.
