Creates the Multi-family Fire Compartmentalization Act.
Defines multi-family dwelling as any building containing 4 or
more living units other than a hotel or motel. Provides
that, except for a multi-family dwelling in any county having
a population over 3,000,000, the owner of a multi-family
dwelling constructed after the effective date of this Act is
entitled to claim an alternate valuation of the property
under the Property Tax Code if it is certified by the
building inspector that certain fire-resistance requirements
are met. Provides that, after the owner receives building
inspector certification and files a request for an alternate
valuation with the chief county assessment officer, the
officer shall assess the property as if it meets the
fire-resistance requirements and as if it does not, and the
lower of the 2 assessments shall be applied.

1 AN ACT concerning new construction of multi-family
2 dwellings.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 1. Short title. This Act may be cited as the
6 Multi-family Fire Compartmentalization Act.
7 Section 5. Definitions. As used in this Act:
8 "Building inspector" means a person designated by the
9 unit of local government in which the building is located who
10 inspects newly constructed buildings for compliance with
11 applicable building codes.
12 "Fire rating" means the time in minutes or hours that a
13 material or an assembly of materials will successfully
14 sustain exposures to fire as determined by a fire test
15 conducted in conformance with the applicable provisions of
16 the American Society for Testing and Materials (ASTM)
17 Designation: E119-95a "Standard Test Methods for Fire Tests
18 of Building Construction and Materials".
19 "Multi-family dwelling" means any building containing 4
20 or more living units other than a hotel or motel.
21 Section 10. Applicability. This Act does not apply to
22 any county having a population of 3,000,000 or more.
23 Section 15. Multi-family dwelling units separated by fire
24 separation walls and floors. The owner of a multi-family
25 dwelling constructed after the effective date of this Act is
26 entitled to claim an alternate valuation of the property
27 under Division 3.5 of Article 10 of the Property Tax Code if
28 each living unit is separated from adjacent living units by
29 non-combustible, fire resistive, hollow core pre-cast

1 concrete, brick, or concrete masonry walls and floors with a
2 minimum fire rating of 2 hours.
3 Section 20. Certification of compliance. The building
4 inspector shall issue a certificate of compliance certifying
5 that newly constructed multi-family dwellings meet the
6 criteria regarding fire resistant walls and floors for
7 multi-family dwellings under this Act before the owner of
8 that property may claim an alternate valuation of the
9 property under Division 3.5 of Article 10 of the Property Tax
10 Code.
11 Section 25. The Property Tax Code is amended by adding
12 Division 3.5 to Article 10 of Title 3 as follows:

18 Sec. 10-37. Valuation of property complying with fire
19 compartmentalization standards. When a person who is the
20 owner of a multi-family dwelling receives a certificate of
21 compliance under Section 20 of the Multi-family Fire
22 Compartmentalization Act, that person is entitled to claim,
23 by filing with the chief county assessment officer, an
24 alternate valuation of that multi-family dwelling. When a
25 claim for an alternate valuation is filed, the chief county
26 assessment officer shall ascertain the value of the dwelling
27 as if equipped with materials that do not meet the
28 specifications provided in the Multi-family Fire
29 Compartmentalization Act and the value of the dwelling as if
30 equipped with materials that meet the specifications provided

1 in the Multi-family Fire Compartmentalization Act. The
2 alternate valuation computed as the lesser of the 2 values
3 ascertained under this paragraph shall be applied.
