1 AMENDMENT TO HOUSE BILL 504
2 AMENDMENT NO. . Amend House Bill 504 on page 1,
3 immediately below line 22, by inserting the following:
4 "(a)(1) "Assisted living establishment" or
5 "establishment" means a home, building, residence, or any
6 other place where the services described below are provided:
7 (A) community-based residential care, including
8 housing and personal and health-related services, to
9 persons who need help with activities of daily living;
10 (B) supportive and intermittent health-related
11 services that are available 24 hours per day, if needed,
12 to meet scheduled and unscheduled needs of a tenant, in a
13 way that promotes self-direction and participation in
14 decisions that emphasize independence, individuality,
15 privacy, and dignity in a residential surrounding;
16 (C) sleeping accommodations for 3 or more unrelated
17 adult tenants, at least 80 percent of which are 55 years
18 of age or older; and
19 (D) all Group 1 services and one or more Group 2
20 services, whether provided directly by the establishment
21 or by another entity arranged for by the establishment
22 with the consent of the tenant or tenant's
23 representative.
24 An "assisted living establishment" or

1 "establishment" also means a home, building, residence,
2 or any other place that provides the services of items
3 (A) through (D) of this paragraph, and, in addition, any
4 Group 3 services.
5 (2) "Assisted living establishment" or "establishment"
6 does not mean:
7 (A) a home, institution, or similar place operated
8 by the federal government or the State of Illinois;
9 (B) a "long term care facility" licensed under the
10 Nursing Home Care Act. However, a long term care facility
11 may apply under this Act to convert sections of the
12 facility to assisted living. If the long term care
13 facility elects to do so, the facility retains the
14 Certificate of Need for its nursing beds that were
15 converted;
16 (C) a hospital, sanitarium, or other institution,
17 the principal activity or business of which is the
18 diagnosis, care, and treatment of human illness and that
19 is required to be licensed under the Hospital Licensing
20 Act;
21 (D) a "facility for child care" as defined in the
22 Child Care Act of 1969;
23 (E) a "community living facility" as defined in the
24 Community Living Facilities Licensing Act;
25 (F) a "community residential alternative" as
26 defined in the Community Residential Alternatives
27 Licensing Act;
28 (G) a nursing home or sanitarium operated solely by
29 and for persons who rely exclusively upon treatment by
30 spiritual means through prayer, in accordance with the
31 creed or tenants of a well-recognized church or religious
32 denomination;
33 (H) a facility licensed by the Department of Human
34 Services as a "community-integrated living arrangement"

1 as defined in the Community-Integrated Living
2 Arrangements Licensure and Certification Act;
3 (I) a "supportive residence" licensed under the
4 Supportive Residences Licensing Act;
5 (J) a "life care facility" as defined in the Life
6 Care Facilities Act; and
7 (K) a freestanding hospice facility.
8 (3) For the purposes of this subsection, "Group 1
9 services" include the following:
10 (A) meals provided in a dining room or the
11 tenant's own room and prepared by the establishment or
12 an outside contractor;
13 (B) housekeeping services, including but not
14 limited to vacuuming, dusting, and cleaning the kitchen
15 and bathrooms of the tenant's unit;
16 (C) security provided 24 hours each day, including
17 but not limited to locked entrances or building or
18 contract security personnel.
19 (D) an emergency communication response system,
20 which is a procedure in place 24 hours each day by which
21 a tenant can notify building management, an emergency
22 response vendor, or others able to respond to his or her
23 need for assistance.
24 (4) For the purposes of this subsection, "Group 2
25 services" include the following:
26 (A) personal care, including one or more of the
27 following: assistance with bathing, dressing, grooming,
28 ambulating, toileting, transferring, meal planning, and
29 personal laundry;
30 (B) medication management, including one or more of
31 the following: reminders to take medication, monitoring
32 of tenant medications, storage of medications, and
33 assisting tenants with medications set up by a family
34 member or nurse;

1 (C) intermittent health services, including one or
2 more of the following: medication administration,
3 dressing changes, catheter care, therapies, and other
4 medical, nursing, or rehabilitative care provided by
5 personnel licensed under the Home Health Agency Licensing
6 Act and by the Department of Professional Regulation.
7 (5) For the purposes of this subsection, "Group 3
8 services" include the following:
9 (A) transportation, including but not limited to
10 car or van service for shopping and medical appointments;
11 (B) a health assessment, which is a health history,
12 physical examination, risk profile, or screening by
13 licensed health care personnel;
14 (C) counseling for health, social services, and
15 nutrition by licensed personnel;
16 (D) social or educational activities, including but
17 not limited to trips, classes, lectures, and parties in
18 or outside the establishment.
19 (6) For the purposes of this subsection, "tenant" means
20 a person residing in an assisted living establishment."; and
21 on page 1, line 23, immediately before ""Authority"", by
22 inserting "(b)"; and
23 on page 1, line 24, immediately before ""Elder Care Savings
24 Bonds"", by inserting "(c)"; and
25 on page 2, line 5, immediately after "sold", by inserting "in
26 fiscal year 1998 and the following fiscal years,"; and
27 on page 5, immediately below line 29, by inserting the
28 following:
29 "(7) Care in an assisted living establishment.";
30 and
31 on page 9, by deleting lines 12 through 30; and
