1 AN ACT to amend the Public Utilities Act by changing
2 Section 8-301.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Public Utilities Act is amended by
6 changing Section 8-301 as follows:

8 Sec. 8-301. Standards of service; tests. The Commission
9 shall have power to ascertain, determine, and fix for each
10 kind of public utility suitable and convenient standard
11 commercial units of service, product, or commodity, which
12 units shall be lawful units for the purposes of this Act; to
13 ascertain, determine, and fix adequate and serviceable
14 standards for the measurements of quantity, quality,
15 pressure, initial voltage, or other condition pertaining to
16 the performing of its service or to the furnishing of its
17 product or commodity by any public utility, and to prescribe
18 reasonable regulations for examining, measuring, and testing
19 such service, product, or commodity, and to establish
20 reasonable rules, regulations, specifications, and standards
21 to secure the accuracy of all meters and appliances for
22 examining, measuring, or testing such service, product, or
23 commodity. The Commission may purchase such materials,
24 apparatus and standard measuring instruments as it deems
25 necessary to carry out the provisions of this Section.
26 The Commission shall provide for the inspection of the
27 manner in which every public utility conforms to the
28 reasonable regulations prescribed by the Commission for
29 examining, measuring and testing its service, product, or
30 commodity, and the Commission may supplement such inspections
31 by examining, measuring and testing the service, product or

1 commodity of any public utility. Any consumer or user may
2 have tested any appliance for examining, measuring or testing
3 any such service, product or commodity upon payment of the
4 fees fixed by the Commission. The Commission shall declare
5 and establish reasonable fees to be paid for examining and
6 testing such appliances on the request of consumers or users,
7 the fee to be paid by the consumer or user at the time of his
8 request, but to be repaid to the consumer or user by the
9 public utility if the measuring appliance be found
10 unreasonably defective or incorrect to the disadvantage of
11 the consumer or user.
12 The Commission, its officers, agents, experts or
13 inspectors and employees shall have power to enter upon any
14 premises occupied by any public utility for the purpose of
15 making the examinations and tests provided in the Act, and
16 set up and use on such premises, any apparatus and appliances
17 and occupy reasonable space therefor.
18 All fees collected by the Commission under this Section
19 shall be paid promptly after the receipt of the same,
20 accompanied by a detailed statement of the same, into the
21 Public Utility Fund in the State treasury.
