| 1 | | a manner that is consistent with the requirements provided by |
| 2 | | subsection (a) of this Section, except that the ballot for such |
| 3 | | election shall be in substantially the following form: |

| 5 | | Shall the (name of fire |
| 6 | | department) be dissolved and YES |
| 7 | | consolidated with the (name ------------------------------------------------------------- |
| 8 | | of fire protection district)? NO |
| 9 | | ------------------------------------------------------------- |
| 10 | | If a majority of the votes cast on the question are in |
| 11 | | favor of such dissolution and consolidation, the court shall |
| 12 | | enter an order discontinuing the fire department and |
| 13 | | consolidating it with the fire protection district. |
| 14 | | Thereafter, the fire protection district shall provide |
| 15 | | fire protection services within the municipality, shall |
| 16 | | receive the assets of the former fire department, shall receive |
| 17 | | funding from the municipality, and shall act as the fire |
| 18 | | department for the municipality. |
| 19 | | The rights of the employees of the dissolved fire |
| 20 | | department provided by the Personnel Code, any applicable |
| 21 | | collective bargaining agreements, or under any pension, |
| 22 | | retirement, or annuity plan shall not be affected by this |
| 23 | | amendatory Act of the 99th General Assembly. |
| 24 | | (b) A municipality that is a home rule or non-home rule |
| 25 | | unit may not dissolve a fire department and consolidate it with |
| 26 | | a fire protection district in a manner that is inconsistent |
