AMENDMENT TO SENATE BILL 2386 




2    AMENDMENT NO. ______. Amend Senate Bill 2386 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The MC/DD Act is amended  by adding Section 
52-204 as follows:
 
6    (210 ILCS 46/2-204 new)
7    Sec. 2-204. DD Facility Advisory Board. The DD Facility 
8Advisory Board established under Section 2-204 of the ID/DD 
9Community Care Act shall advise the Department of Public Health 
10on all aspects of its responsibilities under this Act, 
11including the format and content of any rules adopted by the 
12Department of Public Health. Any such rules, except emergency 
13rules adopted pursuant to Section 5-45 of the Illinois 
14Administrative Procedure Act, adopted without obtaining the 
15advice of the DD Facility Advisory Board are null and void. If 
16the Department fails to follow the advice of the DD Facility

1Advisory Board, the Department shall, prior to the adoption of 
2such rules, transmit a written explanation of the reason 
3therefor to the DD Facility Advisory Board. During its review 
4of rules, the DD Facility Advisory Board shall analyze the 
5economic and regulatory impact of those rules. If the DD 
6Facility Advisory Board, having been asked for its advice, 
7fails to advise the Department within 90 days, the rules shall 
8be considered acted upon.
 

9    Section 99. Effective date. This Act takes effect upon 
10becoming law.".
