| 1 | AN ACT concerning local government.
| ||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The Illinois Municipal Code is amended by | ||||||
| 5 | changing Sections 3.1-15-15 and 8-2-9.1 as follows:
| ||||||
| 6 | (65 ILCS 5/3.1-15-15) (from Ch. 24, par. 3.1-15-15)
| ||||||
| 7 | Sec. 3.1-15-15. Holding other offices. A mayor, president,
| ||||||
| 8 | alderman, trustee, clerk, or
treasurer shall not hold
any other | ||||||
| 9 | office under the municipal government during
the term of that | ||||||
| 10 | office, except when the officer is granted a leave of absence
| ||||||
| 11 | from that office or
except as otherwise provided in Sections | ||||||
| 12 | 3.1-10-50, and 3.1-35-135, and 8-2-9.1.
Moreover, an officer | ||||||
| 13 | may serve as a volunteer fireman and receive compensation
for
| ||||||
| 14 | that service.

| 17 | Sec. 8-2-9.1. Budget officer. Every municipality with a | ||||||
| 18 | population of
less than 500,000
(except special charter | ||||||
| 19 | municipalities having a population in excess of
50,000) that | ||||||
| 20 | has adopted this Section 8-2-9.1 and Sections
8-2-9.2
through | ||||||
| 21 | 8-2-9.10 by a two-thirds majority vote of those members of the
| ||||||
| 22 | corporate authorities then holding office shall have a budget | ||||||
| |||||||
| |||||||
| 1 | officer who
shall be designated by the mayor or president, with | ||||||
| 2 | the approval of the
corporate authorities. In municipalities | ||||||
| 3 | operating
under the
commission form of government, the | ||||||
| 4 | commissioner of accounts and
finances shall designate the | ||||||
| 5 | budget officer,
with the approval of the council or board of | ||||||
| 6 | trustees, as the case may
be. In municipalities with a | ||||||
| 7 | managerial form of government, the
municipal
manager shall | ||||||
| 8 | designate the budget officer. The budget officer shall
take an | ||||||
| 9 | oath and post a bond as provided in
Section 3.1-10-25. The | ||||||
| 10 | budget officer may hold another municipal
office,
either | ||||||
| 11 | elected or appointed (including, but not limited to, the office | ||||||
| 12 | of mayor or president in municipalities with a population under | ||||||
| 13 | 10,000), and may receive compensation for both offices except | ||||||
| 14 | when a mayor or president in a municipality with a population | ||||||
| 15 | under 10,000 is also the budget officer.
Article 10 of this | ||||||
| 16 | Code shall not apply to an individual serving as the
budget | ||||||
| 17 | officer. The budget officer shall serve at the pleasure of
the
| ||||||
| 18 | mayor or municipal manager, as the case may be.

| 20 | Section 99. Effective date. This Act takes effect upon | ||||||
| 21 | becoming law.
