AMENDMENT TO SENATE BILL 544




2    AMENDMENT NO. ______. Amend Senate Bill 544 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Illinois Nuclear Facility Safety Act is 
5amended  by adding Section 10 as follows:
 
6    (420 ILCS 10/10 new)
7    Sec. 10. Local government nuclear storage impact fees. 
8Notwithstanding any other provision of law to the contrary, any 
9unit of local government may establish and collect a nuclear 
10storage impact fee. The fee shall be charged to the entity 
11within the boundaries of the unit of local government that 
12operated a nuclear facility immediately before the end of that 
13facility's operating life. The nuclear storage impact fee can 
14be applied retroactively to the date that the nuclear facility 
15ceased operations.
16    The unit of local government shall conduct a public hearing

1before imposing the nuclear storage impact fee. The hearing 
2shall be held within the boundaries of the unit of local 
3government. Notice of the time, place, and purpose of the 
4hearing shall be given at least 10 days before the date of the 
5hearing.".
