AMENDMENT TO HOUSE BILL 6036




2    AMENDMENT NO. ______. Amend House Bill 6036 by replacing 
3everything after the enacting clause with the following:




 
4    "Section 5. The Criminal Code of 2012 is amended  by adding 
5Section 12-5.1b as follows:
 
6    (720 ILCS 5/12-5.1b new)
7    Sec. 12-5.1b. Criminal building management.
8    (a) A person commits criminal building management when, 
9having personal or professional management or control of 
10commercial real estate, whether as a legal or equitable owner 
11or as a managing agent or otherwise, he or she knowingly  
12permits or causes the physical condition or facilities of the 
13commercial real estate to become or remain in any condition 
14that is a contributing factor in the injury or death  of a first 
15responder in the course of his or her official duties and the 
16condition:

1        (1) resulted from a cited  building code violation of 
2    which the person received notice and the condition was not 
3    corrected during the time period required by the citation; 
4    or
5        (2) resulted from work done without a proper permit.
6    (b) For purposes of this Section, "first responder" means  
7emergency medical services personnel as  defined in Section 3.5 
8of the Emergency Medical Services (EMS) Systems Act, a law 
9enforcement officer, or firefighter. 
10    (c) Sentence. Criminal building management is a Class 4 
11felony.".
