1    AN ACT concerning finance.

 
2    Be it enacted by the People of the State of Illinois, 
3represented in the General Assembly: 



 
4    Section 5. The Illinois Procurement Code is amended  by 
5adding Section 30-50 as follows:
 
6    (30 ILCS 500/30-50 new)
7    Sec. 30-50. Mobilization payments.
8    (a) As used in this Section, "mobilization payment" means 
9an advance payment to a contractor or subcontractor that 
10enables the contractor or subcontractor to purchase necessary 
11machinery and tools for a project. "Mobilization payment" may 
12also include other goods or services necessary for a project 
13when expressly provided for within the contract. 
14    (b) All contracts under this Code entered into by the 
15Department of Transportation shall provide for mobilization 
16payments unless explicitly rejected by the contractor.
17    (c) When a contract under this Code entered into by the 
18Department of Transportation provides for mobilization 
19payments and the contractor is using the services of a 
20subcontractor, the subcontract shall include terms requiring 
21mobilization payments be made to the subcontractor.
22    Mobilization payments to a subcontractor shall be made on a 
23tiered system based on the total value of the subcontract:
