AMENDMENT TO HOUSE BILL 3573




2    AMENDMENT NO. ______. Amend House Bill 3573 by replacing 
3everything after the enacting clause with the following:

 
 
4    "Section 5. The Humane Care for Animals Act is amended  by 
5changing Section 4 as follows:
 



6    (510 ILCS 70/4)  (from Ch. 8, par. 704)



7    Sec. 4. Prohibited acts. No person may sell, offer for 
8sale, barter,
or give away as a pet or a novelty any rabbit or 
9any baby chick, duckling or
other fowl which has been dyed, 
10colored, or otherwise treated to impart an
artificial color 
11thereto.  Baby chicks or ducklings shall not be sold, offered

12for sale, bartered, or given away as pets or novelties.  
13Rabbits, ducklings
or baby chicks shall not be awarded as 
14prizes.

15    No person, including an employee or volunteer of a carnival 
16or fair, may sell, offer for sale, barter,
or give away as a

1pet or a novelty any hermit crab or goldfish that has been 
2dyed, colored, or otherwise treated to impart an
artificial 
3color thereto. As used in this Section, "carnival" has the 
4meaning given to that term in the Carnival Regulation Act and 
5"fair" has the meaning given to that term in the Amusement Ride 
6and Attraction Safety Act. 
7    A person convicted of violating this Section is guilty of a 
8Class B
misdemeanor.  A second or subsequent violation is a 
9Class 4 felony, with
every day that a violation continues 
10constituting a separate offense.
