410 ILCS 625/3.7 new

     Amends the Food Handling Regulation Enforcement Act. Provides that neither the Department of Public Health nor the health department of a unit of local government may regulate the selling of food that is brought to a bake sale sponsored by a group of individuals or a religious, charitable, or nonprofit organization by individuals attending the bake sale for consumption at the bake sale. Prohibits a business establishment dealing in the sale of food items from sponsoring a bake sale. Provides that no fee may be charged for admission to a bake sale exempt from regulation under the amendatory Act. Defines "bake sale".

1    AN ACT concerning health.
  
 
2    Be it enacted by the People of the State of Illinois,
 
3represented in the General Assembly:
  
 
 
4    Section 5. The Food Handling Regulation Enforcement Act is 
5amended  by adding Section 3.7 as follows:
 
6    (410 ILCS 625/3.7 new)
7    Sec. 3.7. Bake sales.
8    (a) As used in this Section, "bake sale" means an event 
9that meets all of the following conditions:
10        (1) It is a fundraising event where volunteers sell 
11    food items on behalf of a group of individuals or a 
12    religious, charitable, or nonprofit organization.
13        (2) There is no compensation provided to people for 
14    bringing food to or selling food at the event.
15        (3) The event is not conducted for commercial purposes.
16        (4) It is generally understood by the participants at 
17    the event that neither the food nor the facilities have 
18    been inspected by the State or a local certified public 
19    health department.
20    (b) Notwithstanding any other provision of law, neither the 
21Department of Public Health nor the health department of a unit 
22of local government may regulate the selling of food that is 
23brought to a bake sale sponsored by a group of individuals or a

1religious, charitable, or nonprofit organization by 
2individuals attending the bake sale for consumption at the bake 
3sale. Individuals who are not members of a group or 
4organization sponsoring a bake sale may attend the bake sale 
5and consume the food at the event. No fee may be charged for 
6admission to a bake sale that is exempt from regulation under 
7this Section. A business establishment dealing in the sale of 
8food items may not sponsor a bake sale. Bake sale food may not 
9be brought into the kitchen of a business establishment dealing 
10in the sale of food items.
