Amends the Food Handling Regulation Enforcement Act. Provides that neither the Department of Public Health nor the health department of a unit of local government may regulate the selling of food that is brought to a bake sale sponsored by a group of individuals or a religious, charitable, or nonprofit organization by individuals attending the bake sale for consumption at the bake sale. Prohibits a business establishment dealing in the sale of food items from sponsoring a bake sale. Provides that no fee may be charged for admission to a bake sale exempt from regulation under the amendatory Act. Defines "bake sale".

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Food Handling Regulation Enforcement Act is |
| 5 | | amended by adding Section 3.7 as follows: |
| 6 | | (410 ILCS 625/3.7 new) |
| 7 | | Sec. 3.7. Bake sales. |
| 8 | | (a) As used in this Section, "bake sale" means an event |
| 9 | | that meets all of the following conditions: |
| 10 | | (1) It is a fundraising event where volunteers sell |
| 11 | | food items on behalf of a group of individuals or a |
| 12 | | religious, charitable, or nonprofit organization. |
| 13 | | (2) There is no compensation provided to people for |
| 14 | | bringing food to or selling food at the event. |
| 15 | | (3) The event is not conducted for commercial purposes. |
| 16 | | (4) It is generally understood by the participants at |
| 17 | | the event that neither the food nor the facilities have |
| 18 | | been inspected by the State or a local certified public |
| 19 | | health department. |
| 20 | | (b) Notwithstanding any other provision of law, neither the |
| 21 | | Department of Public Health nor the health department of a unit |
| 22 | | of local government may regulate the selling of food that is |
| 23 | | brought to a bake sale sponsored by a group of individuals or a |
