AMENDMENT TO SENATE BILL 3276 




2    AMENDMENT NO. ______. Amend Senate Bill 3276 by replacing 
3everything after the enacting clause with the following:


 
 
4    "Section 5. The State Treasurer Act is amended  by adding 
5Sections 20 and 25 as follows:
 
6    (15 ILCS 505/20 new)
7    Sec. 20. State Treasurer administrative charge.   The State 
8Treasurer may retain an administrative charge for the costs of 
9services associated with the deposit of moneys that are 
10remitted directly to the State Treasurer.  The administrative 
11charge collected under this Section shall be deposited into the 
12State Treasurer's Administrative Fund.  The amount of the 
13administrative charge may be determined by the State Treasurer 
14and shall not exceed 2% of the amount deposited.
15    This Section shall apply to fines, fees, or other amounts 
16remitted directly to the State Treasurer by circuit clerks,

1county clerks, and other entities for deposit into a fund in 
2the State treasury.  This Section does not apply to amounts 
3remitted by State agencies or certified collection specialists 
4as defined in 74 Ill. Admin. Code 1200.50.   This Section shall 
5apply only to any form of fines, fees, or other collections 
6created on or after the effective date of this amendatory Act 
7of the 98th General Assembly.
 
8    (15 ILCS 505/25 new)
9    Sec. 25. State Treasurer's Administrative Fund. All cost 
10recoveries, fees for services, and governmental grants 
11received by the State Treasurer shall be maintained in a trust 
12fund in the State treasury, to be known as the State 
13Treasurer's Administrative Fund.  Moneys in the State 
14Treasurer's Administrative Fund may be utilized by the State 
15Treasurer in the discharge of the duties of the office. All 
16interest earned by the investment or deposit of moneys 
17accumulated in the Fund shall be deposited into the Fund.
 
18    Section 10. The State Finance Act is amended by adding 
19Section 5.855 as follows:
 
20    (30 ILCS 105/5.855 new)
21    Sec. 5.855. The State Treasurer's Administrative Fund.
 
 
22    Section 99. Effective date. This Act takes effect upon
