| 1 | AMENDMENT TO SENATE BILL 1930

| 2 | AMENDMENT NO. ______. Amend Senate Bill 1930 by replacing | ||||||
| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. The Park Commissioners Land Sale Act is amended | ||||||
| 5 | by changing Section 5 as follows: | ||||||
| 6 | (70 ILCS 1235/5) | ||||||
| 7 | (Section scheduled to be repealed on December 31, 2013) | ||||||
| 8 | Sec. 5. Sale of golf course land. | ||||||
| 9 | (a) Any board of park commissioners having the control or | ||||||
| 10 | supervision of any parcel of land that is used for golf course | ||||||
| 11 | purposes or parcel of land that is adjacent to such land used | ||||||
| 12 | for golf course purposes or separated from it by a river in a | ||||||
| 13 | non-home rule county with a population greater than 500,000 but | ||||||
| 14 | less than 1,000,000, and having any piece or parcel of that | ||||||
| 15 | land not exceeding 8 acres in area that is no longer needed or | ||||||
| 16 | deemed necessary or useful for the purpose of that golf course, | ||||||

| 1 | may apply to the circuit court of the county in which the piece | ||||||
| 2 | or parcel of land is situated by petition in writing for leave | ||||||
| 3 | to sell that parcel. Notice of such application shall be given | ||||||
| 4 | by the board of park commissioners in some newspaper published | ||||||
| 5 | in the county at least 10 days before the day named therein | ||||||
| 6 | stating when the application will be made. All persons | ||||||
| 7 | interested may appear before the circuit court either in person | ||||||
| 8 | or by attorney when the application is made and object to the | ||||||
| 9 | granting of the application. After hearing all persons | ||||||
| 10 | interested, if the court deems the granting of the application | ||||||
| 11 | to be for the public interest, it shall direct that the | ||||||
| 12 | property mentioned in the application, or any part thereof, be | ||||||
| 13 | sold and conveyed by the board of park commissioners upon such | ||||||
| 14 | terms and conditions as the court may think proper. | ||||||
| 15 | (b) This Section is repealed on December 31, 2018 2013.

| 17 | Section 99. Effective date. This Act takes effect upon | ||||||
