AMENDMENT TO SENATE BILL 124

AMENDMENT NO. ______. Amend Senate Bill 124 by replacing everything after the enacting clause with the following:

"Section 5. The Public Community College Act is amended by adding Section 2-26 as follows:

(110 ILCS 805/2-26 new)

Sec. 2-26. Made in America Building Grants.

(a) In this Section:

"Construction material" means an article, material, or supply brought to a construction site for incorporation into a building or work, including without limitation an item brought to the site pre-assembled from articles, materials, or supplies.

"Construction materials manufactured in the United States" means (i) an unmanufactured construction material mined or produced in the United States or (ii) a construction material manufactured in the United States if the cost of its components mined, produced, or manufactured in the United States exceeds 50% of the cost of all of its components.

(b) Subject to appropriation, the State Board may issue Made in America Building Grants to community college districts to offset any additional costs incurred by a district as a result of using materials and products manufactured in the United States to construct at least 90% of a community college building.

(c) A community college district may qualify for a Made in America Building Grant if all of the following conditions are met:

(1) At least 90% of the community college building was constructed with construction materials manufactured in the United States. The community college district must show that the construction materials were construction materials manufactured in the United States and were used in the building.

(2) The building was built within 2 years prior to application for the grant.

(3) Bid documents for the project show the cost for construction materials manufactured in the United States that were used in the construction and also show the cost for those same construction materials not manufactured in the United States.

(4) The total cost of using construction materials manufactured in the United States increased the cost of construction by more than 7%.

(d) Annually, the State Board shall review and award Made in America Building Grants during an open meeting of the State Board. In determining which community college districts are to receive grants, the State Board shall weigh the percentage of construction materials manufactured in the United States used in the construction, the difference in cost between using construction materials manufactured in the United States versus construction materials manufactured outside of the United States, and the cost of the project. No grant may exceed 50% of the total difference in cost between using construction materials manufactured in the United States versus construction materials manufactured outside of the United States. A grant may be awarded only upon majority vote of those appointed to the State Board.

(e) The State Board shall adopt rules for the implementation of this Section.

Section 99. Effective date. This Act takes effect July 1, 2015.".
