| 2 | | AMENDMENT NO. ______. Amend Senate Bill 124 by replacing |
| 3 | | everything after the enacting clause with the following:
|
| 4 | | "Section 5. The Public Community College Act is amended by |
| 5 | | adding Section 2-26 as follows: |
| 6 | | (110 ILCS 805/2-26 new) |
| 7 | | Sec. 2-26. Made in America Building Grants. |
| 8 | | (a) In this Section: |
| 9 | | "Construction material" means an article, material, or |
| 10 | | supply brought to a construction site for incorporation into a |
| 11 | | building or work, including without limitation an item brought |
| 12 | | to the site pre-assembled from articles, materials, or |
| 13 | | supplies. |
| 14 | | "Construction materials manufactured in the United States" |
| 15 | | means (i) an unmanufactured construction material mined or |
| 16 | | produced in the United States or (ii) a construction material |

| 1 | | manufactured in the United States if the cost of its components |
| 2 | | mined, produced, or manufactured in the United States exceeds |
| 3 | | 50% of the cost of all of its components. |
| 4 | | (b) Subject to appropriation, the State Board may issue |
| 5 | | Made in America Building Grants to community college districts |
| 6 | | to offset any additional costs incurred by a district as a |
| 7 | | result of using materials and products manufactured in the |
| 8 | | United States to construct at least 90% of a community college |
| 9 | | building. |
| 10 | | (c) A community college district may qualify for a Made in |
| 11 | | America Building Grant if all of the following conditions are |
| 12 | | met: |
| 13 | | (1) At least 90% of the community college building was |
| 14 | | constructed with construction materials manufactured in |
| 15 | | the United States. The community college district must show |
| 16 | | that the construction materials were construction |
| 17 | | materials manufactured in the United States and were used |
| 18 | | in the building. |
| 19 | | (2) The building was built within 2 years prior to |
| 20 | | application for the grant. |
| 21 | | (3) Bid documents for the project show the cost for |
| 22 | | construction materials manufactured in the United States |
| 23 | | that were used in the construction and also show the cost |
| 24 | | for those same construction materials not manufactured in |
| 25 | | the United States. |
| 26 | | (4) The total cost of using construction materials |

| 1 | | manufactured in the United States increased the cost of |
| 2 | | construction by more than 7%. |
| 3 | | (d) Annually, the State Board shall review and award Made |
| 4 | | in America Building Grants during an open meeting of the State |
| 5 | | Board. In determining which community college districts are to |
| 6 | | receive grants, the State Board shall weigh the percentage of |
| 7 | | construction materials manufactured in the United States used |
| 8 | | in the construction, the difference in cost between using |
| 9 | | construction materials manufactured in the United States |
| 10 | | versus construction materials manufactured outside of the |
| 11 | | United States, and the cost of the project. No grant may exceed |
| 12 | | 50% of the total difference in cost between using construction |
| 13 | | materials manufactured in the United States versus |
| 14 | | construction materials manufactured outside of the United |
| 15 | | States. A grant may be awarded only upon majority vote of those |
| 16 | | appointed to the State Board. |
| 17 | | (e) The State Board shall adopt rules for the |
| 18 | | implementation of this Section.

| 19 | | Section 99. Effective date. This Act takes effect July 1, |
| 20 | | 2015.".
