<reference>730 ILCS 150/3</reference><aliasreference></aliasreference><reference>730 ILCS 150/10</reference><aliasreference>from Ch. 38, par. 230</aliasreference><SynopsisText>Amends the Sex Offender Registration Act. Provides that the sex offender shall pay a $100 registration fee at the time of initial registration and at the time of each annual registration. Provides that if the person is unable to pay the full amount of the fee in one lump sum, the registering law enforcement agency may establish a payment plan. Provides that if the person signs a statement under penalty of perjury affirming the person is indigent and unable to pay the registration fee in a lump sum or installments, the person shall perform 100 hours of community service within 90 days of registration, if community service is available. Changes the distribution formula for the fees. Provides that a failure to comply with the registration fee requirements by a person who is required to register as a sex offender is a Class 3 felony. Effective immediately.</SynopsisText><synopsistitle>Senate Committee Amendment No. 1</synopsistitle>
<SynopsisText>Further amends the Sex Offender Registration Act. Replaces the provisions concerning sex offender registration and renewal fees. Provides that $35 of the initial $100 registration fee and $35 of the annual $100 renewal fee shall be retained and used by the registering agency for official purposes. Provides that having retained $35 of the initial registration fee and $35 of the annual renewal fee, the registering agency shall remit the remainder of the fee to State agencies within 30 days of receipt for deposit into specified State funds. Provides that the registering agency shall establish procedures to document the remittance of the $100 initial registration fee and $100 annual renewal fee.</SynopsisText><synopsistitle>Senate Floor Amendment No. 2</synopsistitle>
<SynopsisText>Replaces everything after the enacting clause. Reinstates the provisions of the bill amending the Sex Offender Registration Act. Deletes the provision allowing the law enforcement agency registering the sex offender to waive the registration fee if the offender is indigent. Provides if the offender is unable to pay the full amount of the sex offender registration fee in one lump sum, the registering law enforcement agency may establish a payment plan. Provides if the offender signs a statement under penalty of perjury affirming the offender is indigent and unable to pay the registration fee in a lump sum or installments, the offender shall perform 100 hours of community service within 90 days of registration, if community service is available. Provides a failure to comply with the registration fee requirements by a person who is required to register as a sex offender is a Class 4 felony (instead of a Class 3 felony) and provides the offender is not subject to the mandatory $500 fine that otherwise applies to violations.</SynopsisText></synopsis>
