| 1 | | AN ACT concerning regulation.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Medical Practice Act of 1987 is amended by |
| 5 | | changing Section 2 as follows:
|
| 6 | | (225 ILCS 60/2) (from Ch. 111, par. 4400-2)
|
| 7 | | (Section scheduled to be repealed on November 30, 2011)
|
| 8 | | Sec. 2. Definitions. For purposes of this Act, the
|
| 9 | | following definitions shall have the following meanings,
|
| 10 | | except where the context requires otherwise:
|
| 11 | | 1. "Act" means the Medical Practice Act of 1987.
|
| 12 | | 1.5. "Chiropractic physician" means a person licensed to |
| 13 | | treat human ailments without the use of drugs and without |
| 14 | | operative surgery. Nothing in this Act shall be construed to |
| 15 | | prohibit a chiropractic physician from providing advice |
| 16 | | regarding the use of non-prescription products or from |
| 17 | | administering atmospheric oxygen. Nothing in this Act shall be |
| 18 | | construed to authorize a chiropractic physician to prescribe |
| 19 | | drugs. |
| 20 | | 2. "Department" means the Department of Professional |
| 21 | | Regulation.
|
| 22 | | 3. "Director" means the Director of Professional |
| 23 | | Regulation.
|

| 1 | | 4. "Disciplinary Action" means revocation,
suspension, |
| 2 | | probation, supervision, practice modification,
reprimand, |
| 3 | | required education, fines or any other action
taken by the |
| 4 | | Department against a person holding a license.
|
| 5 | | 5. "Disciplinary Board" means the Medical Disciplinary
|
| 6 | | Board.
|
| 7 | | 6. "Final Determination" means the governing body's
final |
| 8 | | action taken under the procedure followed by a health
care |
| 9 | | institution, or professional association or society,
against |
| 10 | | any person licensed under the Act in accordance with
the bylaws |
| 11 | | or rules and regulations of such health care
institution, or |
| 12 | | professional association or society.
|
| 13 | | 7. "Fund" means the Medical Disciplinary Fund.
|
| 14 | | 8. "Impaired" means the inability to practice
medicine with |
| 15 | | reasonable skill and safety due to physical or
mental |
| 16 | | disabilities as evidenced by a written determination
or written |
| 17 | | consent based on clinical evidence including
deterioration |
| 18 | | through the aging process or loss of motor
skill, or abuse of |
| 19 | | drugs or alcohol, of sufficient degree to
diminish a person's |
| 20 | | ability to deliver competent patient
care.

| 21 | | 9. "Licensing Board" means the Medical Licensing Board.
|
| 22 | | 10. "Physician" means a person licensed under the
Medical |
| 23 | | Practice Act to practice medicine in all of its
branches or a |
| 24 | | chiropractic physician licensed to treat human
ailments |
| 25 | | without the use of drugs and without
operative surgery.

| 26 | | 11. "Professional Association" means an association or
|

| 1 | | society of persons licensed under this Act, and operating
|
| 2 | | within the State of Illinois, including but not limited to,
|
| 3 | | medical societies, osteopathic organizations, and
chiropractic |
| 4 | | organizations, but this term shall not be
deemed to include |
| 5 | | hospital medical staffs.
|
| 6 | | 12. "Program of Care, Counseling, or Treatment" means
a |
| 7 | | written schedule of organized treatment, care, counseling,
|
| 8 | | activities, or education, satisfactory to the Disciplinary
|
| 9 | | Board, designed for the purpose of restoring an impaired
person |
| 10 | | to a condition whereby the impaired person can
practice |
| 11 | | medicine with reasonable skill and safety of a
sufficient |
| 12 | | degree to deliver competent patient care.

| 14 | | Section 99. Effective date. This Act takes effect upon |
| 15 | | becoming law.
