| 1 | | AN ACT concerning education.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The School Code is amended by adding Sections |
| 5 | | 10-20.55 and 34-18.47 as follows:
|
| 6 | | (105 ILCS 5/10-20.55 new) |
| 7 | | Sec. 10-20.55. Recess required in elementary school. |
| 8 | | (a) A school board shall require that schools provide daily |
| 9 | | recess for all students in kindergarten through grade 5. The |
| 10 | | recess must be at least 20 minutes in length. Recess shall |
| 11 | | include unstructured play and may include organized games. If |
| 12 | | the principal determines that the weather is inclement, then |
| 13 | | the principal shall direct that recess be held indoors. |
| 14 | | (b) A school board may require that schools provide daily |
| 15 | | recess for all students in grades 6 through 8. |
| 16 | | (c) A school board shall prohibit the withholding of recess |
| 17 | | as a disciplinary action.
