| 1 | | AN ACT concerning public aid.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Illinois Public Aid Code is amended by |
| 5 | | adding Section 12-4.45 as follows:
|
| 6 | | (305 ILCS 5/12-4.45 new) |
| 7 | | Sec. 12-4.45. Broker services. The Department of |
| 8 | | Healthcare and Family Services shall not contract for |
| 9 | | enrollment broker services for the Medical Assistance Program |
| 10 | | with any entity that has a financial relationship with any |
| 11 | | entity serving the Medicaid eligible population as a direct |
| 12 | | fee-for-service provider, Managed Care Organization (MCO), |
| 13 | | Primary Care Case Management (PCCM), or any other care |
| 14 | | coordination entity. For purposes of this Section "financial |
| 15 | | relationship" means (i) a direct or indirect ownership or |
| 16 | | investment interest in the entity or (ii) a compensation |
| 17 | | arrangement with the entity.

| 18 | | Section 99. Effective date. This Act takes effect upon |
| 19 | | becoming law.
|
