| 1 | | AN ACT concerning regulation.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Environmental Protection Act is amended by |
| 5 | | adding Section 22.43a as follows:
|
| 6 | | (415 ILCS 5/22.43a new) |
| 7 | | Sec. 22.43a. Establishment and expansion of landfills; ban |
| 8 | | in counties with more than 2,000,000 inhabitants. |
| 9 | | (a) Notwithstanding any other provision of law, no person |
| 10 | | shall establish, nor shall the Agency issue a permit for the |
| 11 | | establishment of, a new municipal solid waste landfill unit or |
| 12 | | a new sanitary landfill in a county of more than 2,000,000 |
| 13 | | inhabitants on or after the effective date of this amendatory |
| 14 | | Act of the 97th General Assembly. |
| 15 | | (b) Notwithstanding any other provision of law, no person |
| 16 | | shall laterally expand, nor shall the Agency issue a permit for |
| 17 | | the lateral expansion of, a municipal solid waste landfill unit |
| 18 | | or the expansion of a sanitary landfill in a county of more |
| 19 | | than 2,000,000 inhabitants on or after the effective date of |
| 20 | | this amendatory Act of the 97th General Assembly.

| 21 | | Section 99. Effective date. This Act takes effect upon |
| 22 | | becoming law.
