| 2 | | AMENDMENT NO. ______. Amend House Bill 3816 by replacing |
| 3 | | everything after the enacting clause with the following:

| 4 | | "Section 5. The Gubernatorial Boards and Commissions Act is |
| 5 | | amended by adding Section 25 as follows: |
| 6 | | (15 ILCS 50/25 new) |
| 7 | | Sec. 25. Dissolution of inactive boards and commissions. |
| 8 | | (a) Within 30 days after the effective date of this |
| 9 | | amendatory Act of the 97th General Assembly, each statutorily |
| 10 | | created board or commission not subject to subsection (e) shall |
| 11 | | report to the Secretary of State on that board's or |
| 12 | | commission's last meeting prior to the effective date of this |
| 13 | | amendatory Act of the 97th General Assembly, and the report |
| 14 | | shall include the date, time, and location of the meeting. |
| 15 | | Within 30 days after receiving the reports, the Secretary of |
| 16 | | State shall submit a report to the Governor, the Secretary of |

| 1 | | the Senate, and the Clerk of the House of Representatives, |
| 2 | | listing all statutorily created boards and commissions that |
| 3 | | have not met in the 2 years immediately preceding the effective |
| 4 | | date of this amendatory Act of the 97th General Assembly. If a |
| 5 | | board or commission not subject to subsection (e) does not |
| 6 | | report to the Secretary of State pursuant to this subsection, |
| 7 | | then it shall be deemed to be inactive and subject to the |
| 8 | | provisions of subsections (b) and (c). |
| 9 | | (b) Unless the Governor acts pursuant to subsection (c), if |
| 10 | | a board or commission has not met at least once during the 2 |
| 11 | | years prior to the effective date of this amendatory Act of the |
| 12 | | 97th General Assembly and is reported as inactive pursuant to |
| 13 | | subsection (a), then the board or commission is dissolved at |
| 14 | | the end of the 60-day period set forth in subsection (c). |
| 15 | | (c) Within 60 days after receipt of the report by the |
| 16 | | Secretary of State, the Governor may prevent the dissolution of |
| 17 | | any inactive board or commission by filing a written statement |
| 18 | | with the Secretary of State and the Senate that authorizes the |
| 19 | | continued existence of the board or commission and provides a |
| 20 | | rationale for why the board or commission needs to exist. |
| 21 | | (d) Within 14 days after the 60-day period set forth in |
| 22 | | subsection (c), the Governor shall publish a list of all boards |
| 23 | | and commissions dissolved under subsection (b). The |
| 24 | | Legislative Reference Bureau shall prepare for introduction no |
| 25 | | later than in the annual session of the General Assembly next |
| 26 | | occurring after the list is published by the Governor a |

| 1 | | revisory bill effecting such changes in the statutes as may be |
| 2 | | necessary to conform the statutes to the changes in law made by |
| 3 | | the dissolution of the boards and commissions included in the |
| 4 | | list published by the Governor. The failure of the General |
| 5 | | Assembly to enact such a bill does not affect the validity of |
| 6 | | the dissolution of any board or commission under this Section. |
| 7 | | (e) Any board or commission created after July 1, 2010 is |
| 8 | | exempt from this Section.

| 9 | | Section 99. Effective date. This Act takes effect upon |
| 10 | | becoming law.".
