| 1 | AN ACT concerning State government.
| ||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 1. Short title. This Act may be cited as the | ||||||
| 5 | Gubernatorial Employee Salary Cap Act. | ||||||
| 6 | Section 5. Limitations on salary increases. | ||||||
| 7 | Notwithstanding any other provision of law, except as allowed | ||||||
| 8 | by Section 10 of this Act, during a period of budget emergency, | ||||||
| 9 | as defined in Section 15 of this Act, no Governor's Office | ||||||
| 10 | employee may receive an aggregate salary increase in any State | ||||||
| 11 | fiscal year that exceeds the lesser of (i) 3% or (ii) the | ||||||
| 12 | percentage increase in the Consumer Price Index for All Urban | ||||||
| 13 | Consumers, as published by the Bureau of Labor Statistics of | ||||||
| 14 | the U.S.
Department of Labor for the calendar year immediately | ||||||
| 15 | preceding the calendar year in which the first day of that | ||||||
| 16 | State fiscal year occurs. For the purposes of this Act, the | ||||||
| 17 | term "Governor's Office employee" means (i) any person who is | ||||||
| 18 | employed in the Office of the Governor or the Governor's Office | ||||||
| 19 | of Management and Budget in a position that is not subject to | ||||||
| 20 | any of the jurisdictions of the Illinois Personnel Code or (ii) | ||||||
| 21 | any official or employee of an executive branch State agency | ||||||
| 22 | working under the direction and control of the Governor in a | ||||||
| 23 | position for which he or she was appointed by the Governor with | ||||||

| 1 | the advice and consent of the Senate. The term "Governor's | ||||||
| 2 | Office employee" also includes individuals who are employed in | ||||||
| 3 | the Office of the Governor or the Governor's Office of | ||||||
| 4 | Management and Budget but are paid from an appropriation of any | ||||||
| 5 | other executive branch State agency pursuant to an interagency | ||||||
| 6 | agreement. | ||||||
| 7 | Section 10. Applicability of cap to promotions. During a | ||||||
| 8 | period of budget emergency, as defined in Section 15 of this | ||||||
| 9 | Act, if any executive branch employee under the direction and | ||||||
| 10 | control of the Governor is promoted to an existing position as | ||||||
| 11 | a Governor's Office employee, then the employee may receive an | ||||||
| 12 | aggregate salary increase over the employee's salary on the | ||||||
| 13 | last business day immediately preceding the effective date of | ||||||
| 14 | the promotion commensurate with the duties and | ||||||
| 15 | responsibilities of the existing position. Except as otherwise | ||||||
| 16 | provided by law or by joint resolution of the General Assembly, | ||||||
| 17 | if any executive branch employee under the direction and | ||||||
| 18 | control of the Governor is promoted to a newly created position | ||||||
| 19 | as a Governor's Office employee, then the employee may not | ||||||
| 20 | receive, for the duration of the State fiscal year, an | ||||||
| 21 | aggregate salary increase over the employee's salary on the | ||||||
| 22 | last business day immediately preceding the effective date of | ||||||
| 23 | the promotion that exceeds the lesser of (i) 3% or (ii) the | ||||||
| 24 | percentage increase in the Consumer Price Index for All Urban | ||||||
| 25 | Consumers, as published by the Bureau of Labor Statistics of | ||||||

| 1 | the U.S.
Department of Labor for the calendar year immediately | ||||||
| 2 | preceding the calendar year in which the first day of that | ||||||
| 3 | State fiscal year occurs. | ||||||
| 4 | Section 15. Period of budget emergency. This Act applies | ||||||
| 5 | only during a period of budget emergency. For purposes of this | ||||||
| 6 | Act, a period of budget emergency commences on (i) the date | ||||||
| 7 | determined by the Business Cycle Dating Committee of the | ||||||
| 8 | National Bureau of Economic Research to be the beginning date | ||||||
| 9 | of a recession or (ii) the date of the public announcement by | ||||||
| 10 | the Business Cycle Dating Committee of the beginning date of a | ||||||
| 11 | recession, whichever is later. The period of budget emergency | ||||||
| 12 | shall continue, for purposes of this Act, for either (i) the | ||||||
| 13 | 6-month period following the date selected by the Business | ||||||
| 14 | Cycle Dating Committee as the date the recession has ended or | ||||||
| 15 | (ii) the date of the public announcement by the Business Cycle | ||||||
| 16 | Dating Committee of the ending date of the recession, whichever | ||||||
| 17 | occurs later. This Act does not apply to any salary increase | ||||||
| 18 | granted (i) before the effective date of this Act or (ii) | ||||||
| 19 | during any period of a State fiscal year when a budget | ||||||
| 20 | emergency is not in effect.
| ||||||
| 21 | Section 99. Effective date. This Act takes effect upon | ||||||
| 22 | becoming law.
| ||||||
