| 2 | | AMENDMENT NO. ______. Amend House Bill 1327 on page 3, by |
| 3 | | replacing lines 5 through 25 with the following:

| 4 | | "(235 ILCS 5/6-36 new) |
| 5 | | Sec. 6-36. Caffeinated or stimulant-enhanced malt |
| 6 | | beverages. |
| 7 | | (a) For purposes of this Section, "caffeinated or |
| 8 | | stimulant-enhanced malt beverage" means a prepackaged malt |
| 9 | | beverage that contains (1) added caffeine or another stimulant, |
| 10 | | including guarana, ginseng, or taurine and (2) at least 1% |
| 11 | | alcohol by volume. |
| 12 | | (b) No person shall offer for sale a caffeinated or |
| 13 | | stimulant-enhanced malt beverage in this State. |
| 14 | | (c) A person who violates this Section shall be subject to |
| 15 | | a penalty of not more than $1,000."; and
