Provides that if a defendant found unfit to stand trial is placed in the custody of the Department of Human Services, the defendant shall be placed in a secure setting unless: (1) the court determines that there are compelling reasons why such placement is not necessary or (2) the defendant is charged with a misdemeanor and the Department of Human Services determines that he or she could be appropriately placed in a civil setting operated by the Department.
