Provides that the Director of the Division of Alcoholism and Substance Abuse of the Department of Human Services shall (rather than may) establish or authorize programs for prescribing, dispensing, or distributing naloxone hydrochloride or any other similarly acting and equally safe drug approved by the U.S. Food and Drug Administration for the treatment of drug overdose. Amends the Cannabis Control Act, the Illinois Controlled Substances Act, and the Methamphetamine Control and Community Protection Act. Provides that a person acting in good faith who seeks medical assistance for someone experiencing a drug-related overdose or a person who experiences a drug-related overdose and is in need of medical assistance shall not be charged or prosecuted for possession of cannabis, a controlled or counterfeit substance or a controlled substance analog, or methamphetamine if the evidence for the charge of possession of cannabis, a controlled or counterfeit substance or a controlled substance analog, or methamphetamine was obtained as a result of the person seeking medical assistance. Amends the Unified Code of Corrections. Provides that it is a mitigating factor in sentencing that the defendant was making a good faith effort to obtain or provide medical assistance for someone who is experiencing a drug-related overdose.
