<reference>205 ILCS 510/12</reference><aliasreference></aliasreference><SynopsisText>     Amends the Pawnbroker Regulation Act. Removes a provision requiring that property under a hold order released to the custody of a law enforcement officer shall be returned to the pawnbroker upon completion of the criminal investigation. Removes a provision requiring the prosecuting attorney to notify the pawnbroker if property under a hold order may be needed as evidence in a criminal case. Provides that a law enforcement agency shall retain custody of property under a hold order and released by a pawnbroker to the law enforcement agency until the disposition of the case. Provides that, within 15 days after the disposition of the case, if appropriate, the property shall be returned to the owner. Effective immediately.</SynopsisText><synopsistitle>House Floor Amendment No. 2</synopsistitle>
<SynopsisText>Replaces everything after the enacting clause. Amends the Pawnbroker Regulation Act. In a Section concerning hold orders on property believed to be misappropriated goods, provides that, in cases where criminal charges have been filed and the property may be needed as evidence, the prosecuting attorney may retain custody of the property until the disposition of the case by providing written notice to the pawnbroker. Provides that, if the prosecuting attorney has retained custody of the property until the disposition of the case, the property shall be returned to the pawnbroker within 15 days after the disposition of the case unless a court order stipulates transfer of ownership to another person. Provides that a court order stipulating transfer of ownership to another person shall provide that the defendant pay restitution to the pawnbroker in the amount received by the defendant for the property together with reasonable attorney's fees plus any interest or fees due to the pawnbroker.
