In regard to setting the annual eligibility level for the Energy Assistance Program, provides that for the period ending June 30, 2013, the Department of Commerce and Economic Opportunity may not establish limits higher than 200% of the federal nonfarm poverty level (rather than for the period ending June 30, 2012, or until the expenditure of federal resources allocated for energy assistance programs by the American Recovery and Reinvestment Act, whichever occurs first, the Department may not establish limits higher than 200% of that poverty level). Amends the Illinois Public Aid Code if and only if Senate Bill 2840 of the 97th General Assembly becomes law. Extends the moratorium on eligibility expansions from 2 years to 4 years and provides that the moratorium does not apply to expansions approved by the federal government that are financed entirely by units of local government and federal matching funds. In regard to classes of persons eligible under the Medical Assistance Program, extends eligibility to persons who, pursuant to a waiver approved by the Secretary of the U.S. Department of Health and Human Services, are eligible for medical assistance under Title XIX or XXI of the Social Security Act. Permits the Department of Healthcare and Family Services to adopt rules concerning the waiver program. Provides that notwithstanding any other provision of this Code, if the United States Supreme Court holds Title II, Subtitle A, Section 2001(a) of Public Law 111-148 to be unconstitutional, or if a holding of Public Law 111-148 makes Medicaid eligibility allowed under Section 2001(a) inoperable, or if an Act of Congress that becomes a Public Law eliminates Section 2001(a) of Public Law 111-148, the State or a unit of local government shall be prohibited from enrolling individuals in the Medical Assistance Program as the result of federal approval of a State Medicaid waiver on or after the effective date of this amendatory Act, and any individuals enrolled in the Medical Assistance Program pursuant to eligibility permitted as a result of such a State Medicaid waiver shall become immediately ineligible. Makes changes to provisions concerning presumptive eligibility and the County Provider Trust Fund. Effective immediately, but not before the effective date of Senate Bill 2840 of the 97th General Assembly.</SynopsisText><synopsistitle>Senate Floor Amendment No. 6</synopsistitle>
