Provides that if a nuisance lien has been filed against a property, then those costs associated with the lien may be treated as an existing, judicially-approved special assessment, as though an assessment warrant had been issued. Further provides that the municipality may collect the costs as a special assessment if it complies with applicable procedures. Requires that the owner of record or persons interested in the property shall pay the costs incurred by the municipality for collecting the costs associated with the lien. Defines "nuisance lien." Effective immediately.House Committee Amendment No. 1 Deletes reference to:65 ILCS 5/9-2-4.5Adds reference to:215 ILCS 5/397.1from Ch. 73, par. 1009.1Replaces everything after the enacting clause. Amends the Illinois Insurance Code. In the provision concerning certificates regarding payment of taxes and expenses on property sustaining loss, provides that for any such claim an insured property owner must submit a certificate to the insurance company establishing (i) that there are no unpaid nuisance liens or (ii) the amount of unpaid nuisance liens. Provides that, except under certain circumstances, if a certificate establishing the amount of unpaid nuisance liens is submitted, the insurance company shall pay the unpaid nuisance liens from the proceeds payable. Makes corresponding changes in the provision concerning certificates regarding payment of taxes and expenses on property sustaining loss.
