<reference>220 ILCS 5/16-120</reference><aliasreference></aliasreference><SynopsisText>     Amends the Public Utilities Act. Provides that beginning in 2012, the Illinois Commerce Commission shall prepare an annual report regarding the development of electricity markets in Illinois which shall be filed by April 1 of each year with the Joint Committee on Legislative Support Services of the General Assembly and the Governor and which shall be publicly available. Provides that the report shall include, at a minimum, specified information, including the status of consumer protections for the retail customers of alternative retail electric suppliers, and recommendations for improving such consumer protections whether through administrative action, Commission rule, or recommendations to the General Assembly for adoption based on conditions in Illinois and other states with competitive markets for retail electric customers.</SynopsisText><synopsistitle>Senate Floor Amendment No. 1</synopsistitle>

Amends the Public Utilities Act if and only if Senate Bill 1652 of the 97th General Assembly becomes law. Provides that an electricity provider shall measure and charge or credit for the net electricity supplied to eligible customers or provided by eligible customers whose electric service has not been declared competitive and whose electric delivery service is provided and measured on a kilowatt-hour basis and electric supply service is provided based on hourly pricing. Removes a provision concerning General Assembly findings. Provides that a participating utility voluntarily elects and commits to undertake the customer assistance program that consists of specified commitments and obligations. Provides that if a participating utility files a performance-based formula rate tariff without obtaining approval from the Commission or any other agency specified in the Act, then a participating utility other than a combination utility shall pay $10,000,000 per year for 5 years and a participating utility that is a combination utility shall pay $1,000,000 per year for 10 years to fund customer assistance programs with the primary purpose being avoidance of imminent disconnection. Provides that payments made by a participating utility shall not be a recoverable expense. Provides that programs that use funds that are provided by a participating utility to reduce utility bills may be implemented through tariffs. Provides that if the Commission finds that a participating utility is no longer eligible to update the performance-based formula rate tariff or the performance-based formula rate is otherwise terminated then the participating utility's voluntary commitments and obligations shall immediately be terminated. Makes changes to financial penalties concerning incremental annual performance goals. Makes other changes. <SynopsisText>Provides that for the infrastructure investment program period, the ramp-up and ramp-down time shall not exceed a total of 6 months. Provides that financial penalties shall be applied for the 12-month period in which the deficiency occurred through a separate tariff mechanism, which shall be filed by the utility together with its metrics. Changes the specifications of the Governor's 5 appointments to the Smart Grid Advisory Council. Makes other technical changes.</SynopsisText></synopsis>
