Cavaletto 1/8/2013HouseSession Sine Die 725 ILCS 5/Art. 106F heading new725 ILCS 5/106F-5 new Amends the Code of Criminal Procedure of 1963 if and only if Senate Bill 3539 of the 96th General Assembly becomes law. Provides that the following question of public policy shall be submitted to the electors of the State at the 2012 general election: "Should the General Assembly of the State of Illinois enact a law providing for capital punishment for first degree murder and establishing procedures for the imposition of capital punishment that are consistent with the United States Constitution as interpreted by the United States Supreme Court?". Contains an internal repealer. Effective immediately or on the effective date of Senate Bill 3539 of the 96th General Assembly, whichever is later.Land Conveyance Appraisal Note (Dept. of Transportation) No land conveyances are included in this bill. Balanced Budget Note (Office of Management and Budget) HB 1520 does not appear to have a significant fiscal impact as additional administrative burden on the State Board of Elections as well as local election officials would be negligible. Judicial Note (Admin Office of the Illinois Courts) Would neither increase nor decrease the number of judges needed in the state. State Debt Impact Note (Government Forecasting & Accountability) HB 1520 would not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness.Housing Affordability Impact Note (Housing Development Authority) This bill will have no effect on the cost of constructing, purchasing, owning, or selling a single-family residence.Correctional Note (Dept of Corrections) This legislation has no fiscal or population impact on the Department. State Mandates Fiscal Note (Dept. of Revenue) HB 1520 does not create a State mandate. Home Rule Note (Dept. of Commerce & Economic Opportunity) HB 1520 does not pre-empt home rule authority. Fiscal Note (Dept of Corrections) There is no corrections population or fiscal impact on the Department of Corrections.
