| AMENDMENT TO SENATE BILL 3459
|

| AMENDMENT NO. ______. Amend Senate Bill 3459 on page 9, by |

| replacing lines 18 through 26 with the following: |

| "(f-5) If the owner that has been given consent under this |
| 5 |
| Section to locate, place or construct upon, under or along any |
| 6 |
| highway, any ditch, drain, track, rail, pole, wire, pipe line, |
| 7 |
| or other equipment shall fail to comply with a the State or |
| 8 |
| county highway authority request to remove, relocate or modify |
| 9 |
| its ditch, drain, track, rail, pole, wire, pipe line, or other |
| 10 |
| equipment, the State or county highway authority shall bill the |
| 11 |
| owner thereof for any claims paid to contractors for damages, |
| 12 |
| including project overhead, down-time and remobilization of |
| 13 |
| labor, and equipment costs in accordance with compensation |
| 14 |
| provided for in the Illinois Department of Transportation |
| 15 |
| Standard Specifications for Road and Bridge Construction."; |

| and

| on page 10, by deleting lines 1 through 7.
