| 5 | | on page 12, line 20, by replacing "process" with "processes"; |
| 6 | | and
|
| 7 | | on page 12, line 23, by replacing "as required" with "and to |
| 8 | | retain an expert to assist in the review of contracts"; and
|
| 9 | | on page 12, line 24, by replacing "and" with ". This Code"; and
|
| 10 | | on page 27, line 4, by deleting "gasification"; and
|
| 11 | | on page 28, line 10, by deleting "and approve"; and
|
| 12 | | on page 28, line 11, by replacing "contracts, ensuring" with |
|

| 1 | | "contract and approve that formula if the Illinois Power Agency |
| 2 | | determines"; and
|
| 3 | | on page 28, by replacing line 22 with "subsection (h); If the |
| 4 | | Illinois Power Agency does not approve of the SNG pricing |
| 5 | | formula, then the Illinois Power Agency shall modify the |
| 6 | | formula to ensure that it meets the requirements of this |
| 7 | | subsection (h);"; and

| 8 | | by replacing line 25 on page 29 through line 5 on page 30 with |
| 9 | | "Illinois Power Agency may, in its discretion, retain an |
| 10 | | independent, qualified, and experienced expert to assist in its |
| 11 | | obligations under this subsection (h). The Illinois Power |
| 12 | | Agency shall adopt and make public policies detailing the |
| 13 | | processes for retaining a mediator and an expert under this |
| 14 | | subsection (h). Any mediator or expert retained under this |
| 15 | | subsection (h) shall be retained no later than 60 days after |
| 16 | | the effective date of this amendatory Act of the 96th General |
| 17 | | Assembly."; and
|
| 18 | | on page 30, line 11, after "mediator's", by inserting "and |
| 19 | | expert's"; and
|
| 20 | | on page 64, line 9, after "contracts" by inserting "entered |
| 21 | | into under subsection (h) of this Section".
