AMENDMENT TO SENATE BILL 1333

    AMENDMENT NO. ______. Amend Senate Bill 1333, AS AMENDED,

with reference to page and line numbers of House Amendment No. 
4
1, on page 8, by replacing line 7 with the following:

    "Section 1000.1. The Illinois Governmental Ethics Act is 
6
amended  by adding Section 3A-40 as follows:

    (5 ILCS 420/3A-40  new)
8
    Sec. 3A-40. Written and signed personnel recommendations; 
9
disclosure.

    (a) An individual or entity may not refer or recommend any 
11
individual for nomination, appointment, or employment (i) as a 
12
member or employee of an executive board or commission or (ii) 
13
as an official or employee of an executive State agency, unless 
14
the reference or recommendation is made in writing and is 
15
signed by the individual or entity making the reference or 
16
recommendation.

    (b) Neither the Governor nor any member, official, or 
2
employee of an  executive board or commission or executive State 
3
agency may nominate, appoint, or employ an individual to or in  
4
a position described in subsection (a), unless all references 
5
and recommendations concerning that individual are reduced to 
6
writing and signed as required by this Section.
7
    (c) All written and signed references and recommendations 
8
under this Section are public documents and must be made 
9
available for public inspection and copying during normal 
10
business hours.

    (d) In this Section, "executive board or commission" and 
12
"executive State agency" have the same meanings as those terms 
13
are defined in the Officials and Employees Termination Act of 
14
2009.

    (e) Knowingly violating this Section is a business offense 
16
punishable by a fine of $1,001.

    Section 1000.2. The State Officials and Employees Ethics 
18
Act".
